RAMKUMAR, J.\n                    .........................................\n                       B.A. NO.7591 of 2009\n                    ..........................................\n                          Dated: 31.03.2010\n\n                                   ORDER\n<\/pre>\n<p>      Petitioner who is the accused in Crime No.1647 of 2009 of<br \/>\nThrikkakkara Police Station for offences punishable under Section<br \/>\n376 I.P.C., seeks anticipatory bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.\n<\/p>\n<p>      3.      Anticipatory bail cannot be granted in a case of this<br \/>\nnature. But at the same time, I am inclined to permit the petitioner<br \/>\nto surrender before the Investigating Officer for the purpose of<br \/>\ninterrogation and then to have his application for bail considered by<br \/>\nthe Magistrate having jurisdiction. Accordingly, the petitioner shall<br \/>\nsurrender before the investigating officer on 16.04.2010 or<br \/>\n17.04.2010 for the purpose of interrogation and                 recovery of<br \/>\nincriminating material,       if any.      The petitioner shall thereafter<br \/>\nappear before the Magistrate who on being satisfied that the<br \/>\npetitioner has been interrogated by the police shall consider and<br \/>\ndispose of his application for regular bail preferably on the same<br \/>\ndate on which it is filed.
