We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 video \u00a0 conferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n<p>present\u00a0in\u00a0the\u00a0Fatehabad\u00a0studio\u00a0of\u00a0the\u00a0NIC\u00a0while\u00a0the\u00a0Respondent\u00a0was\u00a0present\u00a0<\/p>\n<p>in\u00a0the\u00a0Hissar\u00a0studio.\u00a0We\u00a0heard\u00a0their\u00a0submissions.<\/p>\n<p>3.      The\u00a0Appellant\u00a0had\u00a0sought\u00a0a\u00a0number\u00a0of\u00a0details\u00a0regarding\u00a0the\u00a0interview\u00a0<\/p>\n<p>conducted\u00a0on\u00a012\u00a0November\u00a01997\u00a0for\u00a0promotion\u00a0to\u00a0the\u00a0post\u00a0of\u00a0Special\u00a0Assistant.\u00a0<\/p>\n<p>Nearly \u00a0 one \u00a0 month \u00a0 after \u00a0 the \u00a0 completion \u00a0 of \u00a0 the \u00a0 stipulated \u00a0 period, \u00a0 the \u00a0 CPIO\u00a0<\/p>\n<p>directed\u00a0him\u00a0to\u00a0approach\u00a0the\u00a0CPIO\u00a0at\u00a0Rohtak\u00a0instead\u00a0for\u00a0the\u00a0said\u00a0information\u00a0<\/p>\n<p>with\u00a0the\u00a0observation\u00a0that\u00a0it\u00a0should\u00a0be\u00a0available\u00a0with\u00a0that\u00a0office.\u00a0Later,\u00a0on\u00a0his\u00a0<\/p>\n<p>appeal,\u00a0the\u00a0Appellate\u00a0Authority\u00a0observed\u00a0that\u00a0the\u00a0relevant\u00a0records\u00a0had\u00a0been\u00a0<\/p>\n<p>sent\u00a0by\u00a0the\u00a0Rohtak\u00a0office\u00a0in\u00a0a\u00a0routine\u00a0manner\u00a0to\u00a0the\u00a0office\u00a0in\u00a0Hissar.\u00a0Thus,\u00a0at\u00a0<\/p>\n<p>the\u00a0end\u00a0of\u00a0several\u00a0months\u00a0of\u00a0effort\u00a0and\u00a0approaching\u00a0both\u00a0the\u00a0CPIO\u00a0and\u00a0the\u00a0<\/p>\n<p>Appellate\u00a0Authority\u00a0of\u00a0the\u00a0bank,\u00a0the\u00a0Appellant\u00a0did\u00a0not\u00a0get\u00a0any\u00a0information.<\/p>\n<p>CIC\/SM\/A\/2010\/001188\n<\/p>\n<p> 4.      During \u00a0 the \u00a0 hearing, \u00a0 the \u00a0 Respondent \u00a0 completely \u00a0 failed \u00a0 to \u00a0 explain\u00a0<\/p>\n<p>satisfactorily \u00a0 why \u00a0 the \u00a0 RTI \u00a0 application \u00a0 had \u00a0 not \u00a0 been \u00a0 transferred \u00a0 to \u00a0 the\u00a0<\/p>\n<p>appropriate\u00a0CPIO\u00a0within\u00a0five\u00a0days\u00a0of\u00a0receiving\u00a0it\u00a0and\u00a0why\u00a0was\u00a0he\u00a0advised\u00a0nearly\u00a0<\/p>\n<p>a\u00a0 month\u00a0 after\u00a0the\u00a0 stipulated\u00a0 period\u00a0 to\u00a0 approach\u00a0 some\u00a0 other\u00a0 CPIO.\u00a0 He\u00a0 also\u00a0<\/p>\n<p>failed\u00a0to\u00a0explain\u00a0which\u00a0exact\u00a0office\u00a0of\u00a0the\u00a0bank\u00a0would\u00a0have\u00a0in\u00a0its\u00a0possession\u00a0the\u00a0<\/p>\n<p>desired\u00a0information.\u00a0This\u00a0shows\u00a0complete\u00a0indifference\u00a0and\u00a0casualness\u00a0on\u00a0the\u00a0<\/p>\n<p>part\u00a0of\u00a0the\u00a0officers\u00a0of\u00a0 the\u00a0bank\u00a0dealing\u00a0with\u00a0RTI\u00a0requests.\u00a0In\u00a0this\u00a0case,\u00a0the\u00a0<\/p>\n<p>Appellant\u00a0was\u00a0compelled\u00a0to\u00a0move\u00a0from\u00a0place\u00a0to\u00a0place\u00a0and\u00a0authority\u00a0to\u00a0authority\u00a0<\/p>\n<p>in \u00a0 search \u00a0 of\u00a0 some\u00a0 information\u00a0 which\u00a0 was\u00a0 his\u00a0 legitimate\u00a0 right \u00a0 to \u00a0 get. \u00a0 In \u00a0 the\u00a0<\/p>\n<p>process,\u00a0the\u00a0Appellant\u00a0submitted,\u00a0he\u00a0suffered\u00a0a\u00a0lot\u00a0of\u00a0harassment\u00a0and\u00a0financial\u00a0<\/p>\n<p>loss.\u00a0We\u00a0tend\u00a0to\u00a0agree\u00a0with\u00a0him.\u00a0Indeed,\u00a0from\u00a0the\u00a0manner\u00a0in\u00a0which\u00a0this\u00a0case\u00a0<\/p>\n<p>has\u00a0been\u00a0dealt\u00a0with\u00a0by\u00a0the\u00a0officers\u00a0of\u00a0the\u00a0bank,\u00a0it\u00a0is\u00a0quite\u00a0understandable\u00a0that\u00a0<\/p>\n<p>the \u00a0 Appellant \u00a0 has \u00a0 suffered \u00a0 so \u00a0 much \u00a0 of \u00a0 harassment \u00a0 and, \u00a0 obviously, \u00a0 some\u00a0<\/p>\n<p>financial \u00a0 loss. \u00a0 He \u00a0 deserves \u00a0 to \u00a0 be \u00a0 compensated \u00a0 for \u00a0 this \u00a0 harassment \u00a0 and\u00a0<\/p>\n<p>financial\u00a0loss\u00a0to\u00a0the\u00a0tune\u00a0of\u00a0Rs.\u00a020,000.\n<\/p>\n<\/p>\n<p>5.      In\u00a0exercise\u00a0of\u00a0the\u00a0powers\u00a0vested\u00a0in\u00a0the\u00a0CIC\u00a0in\u00a0Section\u00a019(8)\u00a0(b)\u00a0of\u00a0the\u00a0<\/p>\n<p>Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act,\u00a0we\u00a0direct\u00a0the\u00a0bank\u00a0to\u00a0compensate\u00a0the\u00a0Appellant\u00a0<\/p>\n<p>by\u00a0an\u00a0amount\u00a0of\u00a0Rs.\u00a020,000\u00a0for\u00a0the\u00a0harassment\u00a0and\u00a0financial\u00a0loss\u00a0suffered\u00a0by\u00a0<\/p>\n<p>him. \u00a0 We \u00a0 further \u00a0 direct \u00a0 that \u00a0 the \u00a0 CPIO \u00a0 shall \u00a0 ensure \u00a0 that \u00a0 this \u00a0 amount \u00a0 of\u00a0<\/p>\n<p>compensation\u00a0 is \u00a0 remitted \u00a0 to \u00a0 the \u00a0 Appellant\u00a0 within \u00a0 20 \u00a0 working\u00a0 days\u00a0 from\u00a0 the\u00a0<\/p>\n<p>receipt\u00a0of\u00a0this\u00a0order\u00a0by\u00a0way\u00a0of\u00a0a\u00a0demand\u00a0draft\u00a0and\u00a0compliance\u00a0reported\u00a0to\u00a0the\u00a0<\/p>\n<p>CIC.\n<\/p>\n<\/p>\n<p>6.      We \u00a0 also \u00a0 direct \u00a0 that \u00a0 CPIO \u00a0 shall \u00a0 provide \u00a0 the \u00a0 desired \u00a0 information, \u00a0 if\u00a0<\/p>\n<p>available,\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0In\u00a0case,\u00a0all\u00a0or\u00a0<\/p>\n<p>some\u00a0of\u00a0the\u00a0information\u00a0is\u00a0not\u00a0available,\u00a0the\u00a0CPIO\u00a0shall\u00a0clearly\u00a0say\u00a0so\u00a0in\u00a0his\u00a0<\/p>\n<p>communication\u00a0to\u00a0the\u00a0Appellant.\n<\/p>\n<p>CIC\/SM\/A\/2010\/001188\n<\/p>\n<p> 7.      Although\u00a0it\u00a0was\u00a0noted\u00a0that\u00a0the\u00a0initial\u00a0response\u00a0of\u00a0the\u00a0CPIO\u00a0was\u00a0delayed\u00a0<\/p>\n<p>by\u00a0nearly\u00a0a\u00a0month,\u00a0no\u00a0penalty\u00a0can\u00a0be\u00a0imposed\u00a0since\u00a0the\u00a0officer\u00a0concerned,\u00a0<\/p>\n<p>reportedly,\u00a0has\u00a0already\u00a0retired\u00a0from\u00a0the\u00a0service\u00a0of\u00a0the\u00a0bank.<\/p>\n<p>8.      The\u00a0appeal\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n<p>9.
