Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :26\/02\/2007\n\n O R D E R\n              THOTTATHIL B.RADHAKRISHNAN, J\n\n                      -------------------------------------------\n\n                     W.P(C).No.30181 OF 2006 (R)\n\n                      -------------------------------------------\n\n               Dated this the 26th day of February, 2007\n\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The   District   Collector,   Thrissur,   invited   applications   for<\/p>\n<p>appointment   of   an   authorised   wholesale   distributor   of   ration<\/p>\n<p>articles.     The   choice   fell   in   favour   of   the   petitioner.     The<\/p>\n<p>contesting   5th  respondent   challenged   that   decision   before   the<\/p>\n<p>Civil Supplies Commissioner and later before the Government, as<\/p>\n<p>per Exhibit R5(d).  Ultimately, the Government, as per Exhibit P5<\/p>\n<p>Government   Order,   held   that   the   5th  respondent   is   entitled   to<\/p>\n<p>have   the   allotment   in   his   favour   since   he   provided   a   solvency<\/p>\n<p>certificate   for   rupees   seven   lakhs   and   because   he   was   a<\/p>\n<p>physically handicapped person.\n<\/p>\n<p>2.    The   required   solvency   for   the   purpose   of   the   competition<\/p>\n<p>was for rupees six lakhs, which was provided by the petitioner as<\/p>\n<p>well   as   the   5th  respondent.     Without   a   prescription   being<\/p>\n<p>provided in that regard, it is inappropriate that a comparison of<\/p>\n<p>WPC.30181\/2006(R)<\/p>\n<p><span class=\"hidden_text\">                                   -: 2 :-<\/span><\/p>\n<p>solvency amounts has been made to choose the person  entitled<\/p>\n<p>to be appointed as the dealer.\n<\/p>\n<p>3.    Under   clause   45(2)(a),   a   physically   handicapped   person   is<\/p>\n<p>entitled to be considered with preference, while considering the<\/p>\n<p>question of allotment of retail depots.   That rule does not apply<\/p>\n<p>to wholesale depots.  There is also no rule pointed out before me<\/p>\n<p>which enable the Government to give a preference for physically<\/p>\n<p>handicapped persons, while choosing a wholesale dealer.\n<\/p>\n<p>4.    For   the   foregoing   reasons,   the   observation   in  Exhibit  P5<\/p>\n<p>decision in favour of the 5th respondent goes.\n<\/p>\n<p>5.    Learned   counsel   for   the   5th  respondent   however   submits<\/p>\n<p>that if one goes through the contentions raised in  Exhibit  R5(d)<\/p>\n<p>revision filed by him, it can be easily seen that the Government<\/p>\n<p>did not advert to consider all the rival contentions of the parties.\n<\/p>\n<p>WPC.30181\/2006(R)<\/p>\n<p><span class=\"hidden_text\">                                      -: 3 :-<\/span><\/p>\n<p>6.    Under   the   aforesaid   circumstances,  Exhibit  P5   is   quashed<\/p>\n<p>and   the   matter   is   relegated   for   reconsideration   by   the<\/p>\n<p>Government, in  accordance with  the provisions of the rationing<\/p>\n<p>order.
