Justice V.RAMKUMAR\n\n Dated :26\/03\/2007\n\n O R D E R\n                            V.RAMKUMAR, J.\n\n                            ----------------------------\n\n                      Bail Application No. 1769\/2007\n\n                            -----------------------------\n\n                  Dated this  26th day of March, 2007\n\n\n                                  O R D E R\n<\/pre>\n<p>                 The   petitioner,   who   is   the   fifth   accused   in   Crime<\/p>\n<p>No.210\/2006   of   Vilappilsala   Police   Station   for   offences<\/p>\n<p>punishable  under  Sections  8(2)  and   55(a)  of  the   Abkari   Act  for<\/p>\n<p>allegedly having been found in possession of 8331 litres of spirit<\/p>\n<p>on 22.1.2007 and who was arrested on the same day, seeks his<\/p>\n<p>enlargement on bail.\n<\/p>\n<p>      2.     Even   though   the   learned   Public   Prosecutor   opposed<\/p>\n<p>the application, he fairly conceded that the final report has not<\/p>\n<p>been filed  in  this  case even  after  60  days of judicial  custody of<\/p>\n<p>the petitioner.  If so, the petitioner is entitled to bail as of right.\n<\/p>\n<p>      3.     Accordingly,  the petitioner is directed to be released<\/p>\n<p>on   bail   on   his   executing   a   bond   for   Rs.50,000\/-   (Rupees   fifty<\/p>\n<p>thousand   only)     with   two   solvent   sureties   each   for   the   like<\/p>\n<p>amount   to   the   satisfaction   of   the   J.F.C.M,   Kattakkada,   and<\/p>\n<p>subject to the following conditions:\n<\/p>\n<blockquote><p>              (a).    The petitioner shall report before the<\/p>\n<p>              Investigating   Officer   between   9   a.m.   and<\/p>\n<p>              11 a.m. on  all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>B.A.1769\/2007<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>                    (b).     The   petitioner   shall   make   himself<\/p>\n<p>                    available   for   interrogation   as   and     when<\/p>\n<p>                    required by the police  till  the filing  of the<\/p>\n<p>                    final report.\n<\/p>\n<p>                    (c).     The   petitioner shall not influence or<\/p>\n<p>                    intimidate   the   prosecution   witnesses   nor<\/p>\n<p>                    shall he   attempt to  tamper   with               the<\/p>\n<p>                    evidence for the prosecution.\n<\/p>\n<p>                     (d).    The   petitioner   shall   not  commit  any<\/p>\n<p>                     offence while on bail.\n<\/p>\n<p>        4.
