The<br \/>\nlearned single\tMember of  the Tribunal\t has  dismissed\t the<br \/>\npetitioner&#8217;s application  in O.A.  No.648\/92 by\t order dated<br \/>\nMay 11,\t 1993. Learned\tcounsel Shri  D.K. Garg\t relies upon<br \/>\nSection 5  of the  Administrative Tribunals  Act, 1985\t(for<br \/>\nshort, the  &#8216;Act&#8217;) to  contend that the single Member had no<br \/>\njurisdiction to\t decide the  matter relating to promotion of<br \/>\nthe petitioner. His case is that he joined the Department as<br \/>\na seri-skilled\tHorkman and was later on appointed as Asstt.<br \/>\nStore Keeper  against OEP  vacancy in Dehradun. When juniors<br \/>\nand also seniors to him were promoted in OEP Section, he was<br \/>\nsingled\t out  violating\t his  right  for  consideration\t for<br \/>\nappointment to\tthe higher  post in OEP Section. The case of<br \/>\nthe respondents\t is that  he  was  in  Maintenance  Section,<br \/>\nthough at  the initial\tstage when OEP Section was a cell he<br \/>\nhad worked  therein. Therefore,\t he was\t not eligible  to be<br \/>\nconsidered. All others were transferred along with the posts<br \/>\nto the\tOrdnance factory  while he  remained in\t Maintenance<br \/>\nSection.  As   a  consequence,\tthey  formed  a\t class,\t the<br \/>\npetitioner being a class apart.\n<\/p>\n<p>     The question,  therefore, is whether the learned single<br \/>\nMember of  the Tribunal\t was competent to decide the matter.<br \/>\nWe are\tof the\tview that the member had the jurisdiction to<br \/>\ndecide the  matter for\tthe reason  that it is not a case of<br \/>\ninitial lack of jurisdiction. Undoubtedly, the Vice-Chairman<br \/>\nof the Tribunal by operation of sub-Section (1) of Section 5<br \/>\nhas been  empowered to\tclassify classes  of cases  and make<br \/>\nsitting arrangements  of benches  for convenient disposal of<br \/>\ncases; and  he\thad  ordered  accordingly.  Sub-Section\t (2)<br \/>\nenumerates various  categories of  cases which\tthe  members<br \/>\nwould be  competent to\tdispose of.  When its  member  would<br \/>\ndispose\t of   which  matter   is   one\t of   administrative<br \/>\nconvenience; it\t does not  relate to  his jurisdiction. Even<br \/>\nunder Section  21 of  the Civil\t Procedure  Code  objections<br \/>\nrelating to  pecuniary or  territorial jurisdictional should<br \/>\nbe raised  at the  earliest and if the parties omit to plead<br \/>\nand raise  the objection,  at a\t later\tstage,\tunsuccessful<br \/>\nparty would  be precluded  to raise  lack  of  jurisdiction.<br \/>\nSince the  Tribunal consists  of several  members,  a  bench<br \/>\nconsisting of  a single\t member may  also  be  competent  to<br \/>\ndispose of  certain matters.  The matter having been decided<br \/>\nby him after considering the case on merits, it is no longer<br \/>\nopen to\t the unsuccessful party to plead that the member had<br \/>\nno jurisdiction\t to decide  the\t issue\tor  that  the  order<br \/>\nsuffers from  initial lack of jurisdiction. It may be a case<br \/>\nof improper  disposal of  the matter  without  touching\t the<br \/>\njurisdiction of the member who decided the matter.\n<\/p>\n<p>     Under these circumstances, we do not think there is any<br \/>\nlack of\t jurisdiction warranting  interference.
