S.   Mourya,   learned   counsel     for   the\npetitioner.\n      Heard on admission.\n      The petitioner by way of present petition under\nArticle 226 of the Constitution of India seeks quashment\nof alleged oral order dated 03-08-1993; whereby, as per\nthe petitioner, he has been removed from service.\n      The case of the petitioner is that by order dated\n26-09-1992 he was appointed as Constable and posted in\nEighth Battalion, Chhindwara, district-Chhindwara. It is\nurged that while in service he availed the leave between\n04-06-1993 to 08-06-1993 because of the death of his\nfather. Thereafter because of his depleting health he\ncould not join the duties. It is urged that subsequently in\nthe year 2010 when he approached the authorities for\ntaking him back in service, no action has been taken. It is\naccordingly urged that the oral order of termination\npassed on 03-08-1993 be set aside and respondents be<\/pre>\n<p>directed to reinstate the petitioner in service.\n<\/p>\n<p>      After hearing the learned counsel for the petitioner<br \/>\nthis Court is of considered opinion that the petitioner is<br \/>\nnot entitled for the relief as sought. The order dated<br \/>\n26-09-1992 whereby the petitioner was appointed has not<br \/>\nbeen brought on record as would have indicated the<br \/>\n                                                     WP 8364.11<\/p>\n<p>nature of appointment to ascertain as to whether the<br \/>\npetitioner was taken as probationer. There is no material<br \/>\nalso on record to show that between 1993 when he<br \/>\navailed the leave till 19-11-2010 when a notice under<br \/>\nsection 80 of the Code of Civil Procedure was issued by<br \/>\nhis counsel, any efforts were made by the petitioner to<br \/>\nascertain his status with the respondents.\n<\/p>\n<p>     Mandamus cannot be issued at the instance of the<br \/>\npetitioner for setting aside an order not in existence.<br \/>\nInstead   it   appears   that   the   petitioner   voluntarily<br \/>\nabandoned the service and, therefore, he did not take<br \/>\ninterest for more than 17 years from 1993 to 2010.\n<\/p>\n<p>     In view whereof, the petition since suffers from<br \/>\nlatches, no relief can be granted.\n<\/p>\n<p>     In the result the petition fails and is hereby<br \/>\ndismissed.<\/p>\n<pre>\n\n\n\n\n                                      (SANJAY YADAV)\nsc                                        JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Lok Singh Markam vs The State Of Madhya Pradesh on 5 July, 2011 WP 8364.11 Writ Petition No. 8364 of 2011 05-07-2011 Shri R.
