APP waives service of rule.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication was ordered to be listed with the main Criminal Appeal<br \/>\nNo. 2798\/2008 so as to hear the appeal, if possible. However, that<br \/>\nappeal is tagged with three appeals and Ld. Counsel for the<br \/>\nappellants or the respondent are not in a position to argue and the<br \/>\nCourt is not in a position to hear the main appeals for final<br \/>\ndisposal.\n<\/p>\n<p>3.\t\tUnder<br \/>\nthe circumstances, Ld. Counsel Mr. RM Agrawal pressed the present<br \/>\napplication for bail mainly on the basis that the applicant, a woman,<br \/>\nwas along with her husband in jail since 5\/3\/2003 and has already<br \/>\nundergone 8 years of imprisonment. It was further submitted that<br \/>\nsince the husband of the applicant remains in jail, there is no<br \/>\nchance of the applicant absconding or not abiding by the conditions<br \/>\nof bail. He also submitted that the applicant has good case on merits<br \/>\nin appeal and in view of her personal circumstances of having two<br \/>\nminor sons and two minor daughters living in extremely poor<br \/>\ncondition, the application was required to be allowed.\n<\/p>\n<p>4.\t\tLd.\n<\/p>\n<p>APP opposed the application on the ground that provisions of section<br \/>\n37 of the Narcotic Drugs and Psychotropic Substances Act were<br \/>\nrequired to be kept in view while granting bail even after conviction<br \/>\nof the accused.\n<\/p>\n<p>5.\t\tHaving<br \/>\nregard to the facts and circumstances of the case and the likelihood<br \/>\nof the Criminal Appeals being not heard in the near future, the<br \/>\napplication is allowed and sentence imposed upon the applicant by the<br \/>\nimpugned judgment is suspended and the applicant is ordered to be<br \/>\nreleased on bail on her executing personal bond in the sum of<br \/>\nRs.10,000\/- [Rupees ten thousand only] with one surety of the like<br \/>\namount, if she is not required to be detained  pursuant<br \/>\nto any other case.  Bail before the trial Court.\n<\/p>\n<p>6.\t\tThe<br \/>\nappeals being Criminal Appeal Nos. 1223\/2007, 2798\/2008, 2905\/2008<br \/>\nand 722\/2009 are ordered to be listed for final hearing in the 2nd<br \/>\nweek of February, 2012.\n<\/p>\n<p>\t\tRule<br \/>\nmade absolute accordingly.
