DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/06\/2010 \n\n \n\n \n \n\n\n \n\n \nCOMMON\nORAL ORDER<\/pre>\n<p>Heard<br \/>\n\tlearned counsel Mr.Vikram S. Nandkani, for Mr.Hardik P. Modh,<br \/>\n\tlearned counsel for the petitioner and Mr.Pankaj Champaneri, learned<br \/>\n\tAssistant Solicitor General on behalf of Union of India.\n<\/p>\n<p>It<br \/>\n\tis submitted by learned counsel for the petitioners that all the<br \/>\n\tpetitioners are  Container Freight Station (CFS)  as defined<br \/>\n\tunder Rule-2(s) of the Special Economic Rules, 2006 (for short<br \/>\n\t Rules ). That  Unit  is defined under Section 2(zc) of the<br \/>\n\tSpecial Economic Zones Act, 2005 (for short  Act ). Even,<br \/>\n\t Developer  is also defined under Section 2(g) of the Act. It is<br \/>\n\tfurther submitted that Rule 19(3) of the Rules will be applicable in<br \/>\n\tcase of  Unit  and further as provided under Rule 11(8) of the<br \/>\n\tRules, the petitioners have created only infrastructural facility<br \/>\n\tfor use by the prospective Units. In addition to above, it is<br \/>\n\tsubmitted that the petitioners have already submitted their reply to<br \/>\n\tthe notice which was issued in the year 2008 and even on 10.05.2010<br \/>\n\talso they have approached the concerned Ministry to seek details<br \/>\n\tabout the meeting and the outcome, which took place between the<br \/>\n\tMinistry of Commerce and Ministry of Revenue, to which the<br \/>\n\tpetitioner had no opportunity to represent a case. However, it is<br \/>\n\tsubmitted by learned counsel for the petitioners that all the<br \/>\n\tpetitioners are ready and willing to comply with any instruction\/<br \/>\n\torder issued in accordance with law by Ministry of Commerce\/<br \/>\n\tMinistry of Revenue of Union of India. Therefore, at this stage if<br \/>\n\tthe impugned orders are allowed to be implemented, activities of the<br \/>\n\tpetitioners will come to stand still. It is therefore prayed that<br \/>\n\tpending admission of the cases, further, implementation, operation<br \/>\n\tand execution of the orders be stayed.\n<\/p>\n<p>Mr.Pankaj<br \/>\n\tChampaneri, learned Assistant Solicitor General for Union of India<br \/>\n\trelied on provision of Section 4, 5, 6 and 12 of the Act and<br \/>\n\tsubmitted that as provided under Section 12(3) of the Act,<br \/>\n\tDevelopment Commissioner can exercise administrative control and<br \/>\n\tsupervision over officers and employees appointed under  Section<br \/>\n\t11(2) and has got wide powers. Learned Assistant Solicitor General<br \/>\n\thas also relied on Rule 11(1)(5)(6) and submitted that valid letter<br \/>\n\tof approval is necessary as required under Rule 19(3) of the Rules.<br \/>\n\tIt is further submitted that he would like to seek detailed<br \/>\n\tinstructions and file affidavit-in-reply with regard to the specific<br \/>\n\tcontention in the petition for challenging impugned orders.\n<\/p>\n<p>Considering<br \/>\n\tthe above submissions and provisions of the Act and Rules relied on<br \/>\n\tby learned counsel for the parties, prima facie, the petitioners,<br \/>\n\twho have been permitted to function as  Container Freight Station<br \/>\n\t(CFS)  since 2008 onwards and the Department of Customs has issued<br \/>\n\tnotification for the purpose of Customs Act. Besides, reply\/<br \/>\n\trepresentation submitted by the petitioners as early as in 2008, is<br \/>\n\tnot decided and as stated by learned counsel for the petitioners,<br \/>\n\tthey are ready and willing to comply with any lawful instruction\/<br \/>\n\torder of the Authority under the Act.\n<\/p>\n<p>Issue<br \/>\n\tnotice to respondents, returnable on 23.06.2010. Meanwhile,<br \/>\n\tad-interim relief is granted by staying operation of impugned orders<br \/>\n\tdated 19.05.2010 and 02.06.2010 till then in each of the petitions.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[ANANT<br \/>\nS.
