Justice K.T.SANKARAN\n\n Dated :04\/01\/2010\n\n O R D E R\n                       K.T.SANKARAN, J.\n                   -----------------------------------------\n                      B.A.No.7527 of 2009\n                  ------------------------------------------\n              Dated this the 4th day of January, 2010\n\n\n                              ORDER\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioners are accused Nos.4<\/p>\n<p>and 5 in Crime No.286 of 2009 of Perunad Police Station,<\/p>\n<p>Pathanamthitta District.\n<\/p>\n<p>      2.   The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 450, 427 and 302 read with Section 149<\/p>\n<p>of the Indian Penal Code.\n<\/p>\n<p>      3.   The date of occurrence was on 19.11.2009. The<\/p>\n<p>petitioners were arrested on 21.11.2009 and they were<\/p>\n<p>remanded to judicial custody. The investigation is not over.<\/p>\n<p>      4.   The prosecution case is that the accused persons went<\/p>\n<p>to the canteen run within the campus of Carmel Engineering<\/p>\n<p>College, Perunad for having their dinner.                   Complaining that<\/p>\n<p>there was delay in serving food, the accused persons created a<\/p>\n<p>scene in the canteen. The employees of the canteen directed the<\/p>\n<p>accused to leave the place.          The accused persons came back<\/p>\n<p>with deadly weapons with intent to commit the offence. They<\/p>\n<p><span class=\"hidden_text\">BA No.7527\/2009                   2<\/span><\/p>\n<p>attacked the canteen workers. Accused No.1 hit the deceased<\/p>\n<p>with an iron rod. The deceased sustained head injury and he<\/p>\n<p>succumbed to the injuries while in hospital.<\/p>\n<p>      5.    The learned counsel for the petitioners pointed out<\/p>\n<p>that there is no allegation that the petitioners used any weapon<\/p>\n<p>or that they inflicted any injuries on anybody. It is also submitted<\/p>\n<p>that the allegation of having used a weapon is against accused<\/p>\n<p>No.1.\n<\/p>\n<p>      6.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners on stringent conditions.\n<\/p>\n<p>      The petitioners shall be released on bail on their executing<\/p>\n<p>bond for Rs.25,000\/- each with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-I, Ranni, subject to the following conditions:<\/p>\n<p>a)    The petitioners shall report before the investigating officer<br \/>\n      between 9 A.M. and 11 A.M. on every Monday and<br \/>\n      Thursday, till the final report is filed or until further orders;<\/p>\n<p>b)    The petitioners shall appear before the investigating officer<br \/>\n      for interrogation as and when required;\n<\/p>\n<p><span class=\"hidden_text\">BA No.7527\/2009                   3<\/span><\/p>\n<p>c)   The petitioners shall not enter into the limits of Perunad<br \/>\n     Police Station for a period of two months;<\/p>\n<p>d)   The petitioners shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;\n<\/p>\n<p>e)   The petitioners shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;\n<\/p>\n<p>f)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.\n<\/p>\n<p>\n     The Bail Application is allowed as above.<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                  JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Ajith Solomon Alias Tony vs State Of Kerala on 4 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7527 of 2009() 1.
