Grievance of the present<br \/>\npetition is that application which has been made to the Registrar of<br \/>\nTrade Union under Section 14(A) of the Trade Unions Act, 1926, which<br \/>\nhas not been yet decided by Registrar. She submitted that according<br \/>\nto the constitution of the Trade Union, election is required to be<br \/>\ndeclared by the body of office bearers of respondent-Union, but, they<br \/>\nare not declaring the election, though period is over.\n<\/p>\n<p>2.\tIn<br \/>\nlight of this background, it is directed to respondent No.1-Deputy<br \/>\nRegistrar, Narmada Bhawan, Kothi, Vadodara to examine the application<br \/>\ngiven by petitioner on 30.08.2009 and on 17.04.2010, while exercising<br \/>\nthe power under Section 14(A) of the Trade Unions Act, 1926 in<br \/>\naccordance with law within a period of 15 days from the date of<br \/>\nreceiving a copy of this order.\n<\/p>\n<p>3.\tIn<br \/>\nview of above observations and directions, present petition is<br \/>\ndisposed of by this Court, without expressing any opinion on merits.\n<\/p>\n<p>\tIn<br \/>\npursuance of the order passed by this Court which has been acted upon<br \/>\nby Deputy Registrar of Trade Union Act, Vadodara and dispute in<br \/>\nrespect of office bearer of Trade Union has been given consent under<br \/>\nSection 14(A) of Trade Union Act by order dated 15th June<br \/>\n2010. Therefore, direction which has been issued by this Court by<br \/>\norder dated 13th May 2010 which has been already<br \/>\nimplemented and subsequently, Deputy Registrar of Trade Union Act,<br \/>\nVadodara has passed an order on 15th June 2010, on that<br \/>\nground, present application for review is not maintainable and same<br \/>\ncannot be entertained by this Court, because, order passed by this<br \/>\nCourt is already complied by Deputy Registrar of Trade Union Act,<br \/>\nVadodara.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Ms. Hina Desai submitted that pursuant to the aforesaid<br \/>\norder passed by Deputy Registrar of Trade Union Act dated 15th<br \/>\nJune 2010, for that, T.U. Reference No.2 of 2010 is also pending<br \/>\nbefore Industrial Tribunal, Vadodara.\n<\/p>\n<p>\tIn<br \/>\nlight of these facts, present application is not maintainable.<br \/>\nHowever, allegations which are made in present application against<br \/>\noriginal petitioner by present applicant have been denied by learned<br \/>\nadvocate Ms. Hina Desai. She submitted that whatever submissions made<br \/>\nbefore this Court at the time when order was passed by this Court on<br \/>\n13th May 2010 after receiving the information under the<br \/>\nprovisions of Right to Information Act.\n<\/p>\n<p>\tApart<br \/>\nfrom that without going into controversy between both parties,<br \/>\npresent application is not entertained by this Court.\n<\/p>\n<p>\tIt<br \/>\nis open for applicant to challenge the order passed by Deputy<br \/>\nRegistrar, Trade Union Act, Vadodara dated 15th June 2010,<br \/>\nif he desires, in accordance with law.\n<\/p>\n<p>\tIn<br \/>\nview of above observation and direction, present petition is not<br \/>\nentertained by this Court.
