Justice KURIAN JOSEPH\n\n Dated :13\/07\/2009\n\n O R D E R\n        S.R.BANNURMATH, C.J. &amp; KURIAN JOSEPH, J.\n              ----------------------------------------------\n                     W.P.(C) No.632 of 2009\n              ----------------------------------------------\n                      Dated 13th July, 2009.\n\n                           J U D G M E N T\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>           The writ petition is filed in public interest with the<\/p>\n<p>following prayers :-\n<\/p>\n<blockquote><p>                     &#8220;(i) To issue a writ of mandamus or any other<br \/>\n          appropriate writ, order or direction, directing the second<br \/>\n          respondent to take appropriate steps to remove the<br \/>\n          obstructions caused by the first respondent on the road<br \/>\n          constructed by the Akathethara Grama Panchayat by<br \/>\n          the side of Pudupariayaram Branch Canal.\n<\/p><\/blockquote>\n<blockquote><p>                     (ii) Issue a writ of mandamus or any other<br \/>\n          appropriate writ, order or direction, directing the 4th<br \/>\n          respondent District Collector to take appropriate steps<br \/>\n          on the representation          Ext.P4     submitted by the<br \/>\n          petitioners and take appropriate steps to prevent any<br \/>\n          authorized obstruction caused by the first respondent to<br \/>\n          the road constructed by Akathethara Grama Panchayat<br \/>\n          by the side of the Puduparaiyaram Branch Canal.\n<\/p><\/blockquote>\n<blockquote><p>                     (iii) To issue a writ of mandamus or any other<br \/>\n          appropriate writ, order or direction, directing the first<br \/>\n          respondent not to take any steps to obstruct or to block<br \/>\n          the road constructed by the Akathethara Grama<br \/>\n          Panchayat by the side of the Puduparaiyaram Branch<br \/>\n          Canal, pending disposal of the complaint before the<br \/>\n          District Collector, Palakkad.&#8221;\n<\/p><\/blockquote>\n<p>On 15.1.2009, this court passed an interim order to the effect<\/p>\n<p>that no construction shall be made in the disputed property and<\/p>\n<p>status quo as on that date should be maintained. The interim<\/p>\n<p><span class=\"hidden_text\">WP(C) NO.632\/2009                 2<\/span><\/p>\n<p>order was extended from time to time. In the meanwhile, the<\/p>\n<p>District Collector, Palakkad has taken steps to resolve the<\/p>\n<p>dispute, and in the process a survey also was undertaken. The<\/p>\n<p>District Collector has filed a statement dated 6.6.2009.<\/p>\n<p>Paragraph 2 of the statement reads as follows :-<\/p>\n<blockquote><p>                     &#8220;It is submitted that the contentions involved<br \/>\n          in the Writ Petition have been got enquired through the<br \/>\n          Revenue    Divisional    Officer, Palakkad   and    other<br \/>\n          concerned departments. It is revealed that the land in<br \/>\n          question is comprised in Survey Nos.202, 152, 151,<br \/>\n          150\/9, 203\/9 of Block 24 of Akathethara Village which is<br \/>\n          classified as &#8216;Malampuzha Canal&#8217; and the ownership of<br \/>\n          land is vested with the Irrigation Department and that<br \/>\n          the Government Poramboke is seen unauthorisedly<br \/>\n          encroached by the Railway authorities by constructing<br \/>\n          compound walls.        It is also submitted that the<br \/>\n          unauthorised     obstruction   made   by   the    Railway<br \/>\n          authorities is causing difficulty to the public and<br \/>\n          irrespective of considering the land vested with any<br \/>\n          department, the Government land should be made<br \/>\n          convenient for the public.&#8221;<\/p><\/blockquote>\n<p>           Learned counsel appearing for the Railways submits<\/p>\n<p>that in the process, the Railways may be permitted to take steps<\/p>\n<p>to construct a compound wall so as to protect their property.<\/p>\n<p>Nobody can prevent the Railways from constructing a compound<\/p>\n<p>wall in their own property, after obtaining statutory permission.<\/p>\n<p><span class=\"hidden_text\">WP(C) NO.632\/2009                3<\/span><\/p>\n<p>Therefore, the writ petition is disposed of directing the District<\/p>\n<p>Collector to take appropriate action on Ext.P4 representation in<\/p>\n<p>the light of the steps already taken by the District Collector, some<\/p>\n<p>of which are referred to above, with notice to the petitioners and<\/p>\n<p>respondents 1 to 3. In the process, if any request is made by the<\/p>\n<p>Railways, the same shall also be considered by the District<\/p>\n<p>Collector.
