Whether inspite of\t the<br \/>\nacceptance  of\tthe claim amount and execution of  discharge<br \/>\nvoucher voluntarily, the insured is entitled to the grant of<br \/>\nany  interest?\t Whether  the  Consumer\t Disputes  Redressal<br \/>\nCommissions  constituted under the Consumer Protection\tAct,<br \/>\n1986  are entitled to fasten liability against the insurance<br \/>\ncompanies  over and above the liabilities payable under\t the<br \/>\ncontract  of insurance envisaged in the policy of insurance?<br \/>\nare  the main questions of law required to be adjudicated in<br \/>\nall  these  appeals.  In Civil Appeal No.  535 of  1994\t the<br \/>\nrespondent   No.1   had\t   procured    two   policies\tNos.<br \/>\n201202-11&#8211;43-11-01234-90   from   the\t appellant-insurance<br \/>\ncompany.   Similarly  in  Civil\t Appeal\t No.   723  of\t1994<br \/>\nrespondent  No.1 had procured two insurance covers operative<br \/>\nfrom  20th October, 1989 to 19th June, 1990 to the extent of<br \/>\nRs.1,00,000\/-  and from 3rd April 1990 to 29th June, 1990 to<br \/>\nthe  extent of Rs.10,00,000\/- respectively.  Respondent No.1<br \/>\nhad also procured insurance cover to the tune of Rs.27 lakhs<br \/>\nfrom  respondents 2 to 4.  The respondent suffered losses on<br \/>\naccount\t of fire regarding which the surveyors are appointed<br \/>\nand  upon submission of their reports the payments were made<br \/>\nwhich  were  accepted  by the insured  with  declaration  of<br \/>\nreceipt\t of  the &#8220;sum in full and final discharge of  claims<br \/>\nupon  them&#8221;.  After the payments were made, the\t respondents<br \/>\nfiled complaint petitions before the State Consumer Disputes<br \/>\nRedressal  Commission,\tPunjab at Chandigarh claiming  inter<br \/>\nalia  interest at the rate of 18 per cent per annum  against<br \/>\nthe  appellant.\t  The State Commission dismissed the  claims<br \/>\nbut  the  National  Consumer Disputes  Redressal  Commission<br \/>\naccepted  the appeal of the respondent No.1 and directed the<br \/>\nappellant  to  pay the interest at the rate of 18 per  cent.<br \/>\nThe  facts  in\tCivil  Appeal No.  534 of  1994\t are  almost<br \/>\nidentical  for determining the controversy and deciding\t the<br \/>\nquestion  of  law noted hereinabove.  We have heard  learned<br \/>\ncounsel\t for the parties and perused the record.  It is true<br \/>\nthat  the  award of interest is not specifically  authorised<br \/>\nunder  the Consumer Protection Act, 1986 (hereinafter called<br \/>\n&#8216;the  Act&#8217;) but in view of our judgment in Sovintorg (India)<br \/>\nLtd.   Vs.   State Bank of India (Civil Appeal No.   823  of<br \/>\n1992)  decided\ton 11th August, 1999, we are of the  opinion<br \/>\nthat  in  appropriate  cases the forum and  the\t commissions<br \/>\nunder  the  Act are authorised to grant reasonable  interest<br \/>\nunder  the  facts and circumstances of each case.  The\tmere<br \/>\nexecution  of the discharge voucher would not always deprive<br \/>\nthe  consumer  from  preferring claim with  respect  to\t the<br \/>\ndeficiency  in service or consequential benefits arising out<br \/>\nof  the\t amount\t paid in default of  the  service  rendered.<br \/>\nDespite execution of the discharge voucher, the consumer may<br \/>\nbe  in a position to satisfy the Tribunal or the  Commission<br \/>\nunder  the  Act that such discharge voucher or\treceipt\t had<br \/>\nbeen  obtained from him under the circumstances which can be<br \/>\ntermed\tas  fraudulent or exercise of undue influence or  by<br \/>\nmis-representation  or\tthe  like.  If in a given  case\t the<br \/>\nconsumer  satisfies  the  authority under the Act  that\t the<br \/>\ndischarge voucher was obtained by fraud, mis-representation,<br \/>\nunder  influence or the like, coercive bargaining  compelled<br \/>\nby circumstances, the authority before whom the complaint is<br \/>\nmade  would  be\t justified in granting\tappropriate  relief.<br \/>\nHowever, where such discharge voucher is proved to have been<br \/>\nobtained  under\t any of the suspicious\tcircumstances  noted<br \/>\nhereinabove,  the  tribunal  or\t  the  commission  would  be<br \/>\njustified  in  granting\t the appropriate  relied  under\t the<br \/>\ncircumstances  of  each\t case.\tThe mere  execution  of\t the<br \/>\ndischarge  voucher  and\t acceptance of the  insurance  claim<br \/>\nwould  not estopp the insured from making further claim from<br \/>\nthe  insurer  but  only under the circumstances\t as  noticed<br \/>\nearlier.   The\tConsumer  Disputes   Redressal\tForums\t and<br \/>\nCommissions  constituted  under the Act shall also have\t the<br \/>\npower  to  fasten liability against the insurance  companies<br \/>\nnotwithstanding the issuance of the discharge voucher.\tSuch<br \/>\na  claim  cannot  be termed to be  fastening  the  liability<br \/>\nagainst\t  the  insurance  companies   over  and\t above\t the<br \/>\nliabilities   payable  under  the   contract  of   insurance<br \/>\nenvisaged  in the policy of insurance.\tThe claim  preferred<br \/>\nregarding  the\tdeficiency of service shall be deemed to  be<br \/>\nbased  upon  the  insurance  policy, being  covered  by\t the<br \/>\nprovisions  of Section 14 of the Act.  In the instant  cases<br \/>\nthe  discharge vouchers were admittedly executed voluntarily<br \/>\nand  the complainants had not alleged their execution  under<br \/>\nfraud,\tundue influence, mis-representation or the like.  In<br \/>\nthe  absence of pleadings and evidence the State  Commission<br \/>\nwas  justified in dismissing their complaints.\tThe National<br \/>\nCommission  however  granted relief solely on the ground  of<br \/>\ndelay  in  the settlement of claim under the policies.\t The<br \/>\nmere  delay of a couple of months would not have  authorised<br \/>\nthe  National  Commission to grant relief particularly\twhen<br \/>\nthe  insurer had not complained of such a delay at the\ttime<br \/>\nof  acceptance of the insurance amount under the policy.  We<br \/>\nare  not  satisfied  with  the\treasoning  of  the  National<br \/>\nCommission and are of the view that the State Commission was<br \/>\njustified  in dismissing the complaints though on  different<br \/>\nreasonings.   The  observations of the State  Commission  in<br \/>\nJiyajeerao  Cotton Mills Ltd.  Vs.  New India Assurance\t Co.<br \/>\nLtd.  (Original Petition No.  52 of 1991 decided on November<br \/>\n28,  1991)  shall  always be construed in the light  of\t our<br \/>\nfindings in this judgment and the mere receipt of the amount<br \/>\nwithout any protest would not always debar the claimant from<br \/>\nfiling\tthe complaint.\tUnder the circumstances the  appeals<br \/>\nare  allowed.  The orders of the National Commission are set<br \/>\naside  by  confirming  the  orders   passed  by\t the   State<br \/>\nCommission.
