SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/07\/2009 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Article 226 of the Constitution of India<br \/>\n\tthe petitioner has prayed for an appropriate writ, order or<br \/>\n\tdirection quashing and setting aside the action of the respondents<br \/>\n\tof denying the petitioner compassionate appointment as Junior Clerk.\n<\/p>\n<p>\tAt<br \/>\n\tthe outset, it is required to be noted that the father of the<br \/>\n\tpetitioner was serving as a workcharged labourer  died  in the year<br \/>\n\t1991 and the question of  granting compassionate appointment  to the<br \/>\n\tpetitioner as a Junior Clerk is posed for consideration of this<br \/>\n\tCourt in the year 2009 i.e. after a period of 18 years.\n<\/p>\n<p>\tIdentical<br \/>\n\tquestion came to be considered by this Court in Special Civil<br \/>\n\tApplication Nos. 1678\/1997 and 1903\/2005 and this Court has<br \/>\n\trelied upon the decisions of the Hon&#8217;ble Supreme Court in the case<br \/>\n\tof STATE OF J&amp; K ORS Vs. SAJAD AHMED MIR reported in<br \/>\n\t(2006) 5 SCC 766 and in the case of NATIONAL HYDROELICTRIC<br \/>\n\tPOWER CORPORATION AND ANR Vs. NANAK CHAND AND ANR reported in<br \/>\n\t2004 AIR SCW 6339 rejecting the applications, which were<br \/>\n\tfiled belatedly.\n<\/p>\n<p>\tIn<br \/>\n\tthe decision of NATIONAL HYDROELICTRIC POWER CORPORATION (Supra)<br \/>\n\tthe Hon&#8217;ble Supreme Court has observed that &#8230;&#8230; it is to be seen<br \/>\n\tthat the appointment on compassionate ground is not a source of<br \/>\n\trecruitment, but merely an exception to the requirement regarding<br \/>\n\tappointments being made on open invitation of application on merits.<br \/>\n\t Basic intention is that on the death of the  employee concerned,<br \/>\n\this family is not deprived of means of livelihood.  The object is to<br \/>\n\tenable the family to get over sudden financial crises .\n<\/p>\n<p>\tIn<br \/>\n\tthe decision of   SAJAD AHMED MIR (Supra) it is observed that<br \/>\n\tthe compassionate appointment is exception to the general rule and<br \/>\n\tnormally, an employment in the Government or other public sectors<br \/>\n\tshould be open to all eligible candidates who can come forward to<br \/>\n\tapply and compete with each other. It is in consonance with Article<br \/>\n\t14 of the Constitution. On the basis of competitive merits, an<br \/>\n\tappointment should be made to public office. It is also further<br \/>\n\tobserved by the Hon&#8217;ble Supreme Court that this general rule should<br \/>\n\tnot be departed from except where compelling circumstances demand,<br \/>\n\tsuch as, death of the sole breadwinner and livelihood of the family<br \/>\n\tsuffering because of the setback. It is also further observed by the<br \/>\n\tHon&#8217;ble Supreme Court that once it is proved that inspite of the<br \/>\n\tdeath of the breadwinner, the family survived and substantial period<br \/>\n\tis over, there is no necessity to say  goodbye  to the normal<br \/>\n\trule of appointment and to show favour to one at the cost of the<br \/>\n\tinterests of several others ignoring the mandate of Article 14. In<br \/>\n\tthe case before the Hon&#8217;ble Supreme Court, the learned Single Judge<br \/>\n\tdismissed the petition on the ground of delay and laches. The<br \/>\n\tDivision Bench set aside the said order and passed an order of<br \/>\n\tappointment on compassionate ground. The Hon&#8217;ble Supreme Court set<br \/>\n\taside the order passed by the Division Bench and has observed as<br \/>\n\tabove.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe decision of the Hon&#8217;ble Supreme Court in case of SAJAD AHMED<br \/>\n\tMIR (Supra) and the facts of the present case that more than 12<br \/>\n\tyears have been passed after the death of the deceased employee and<br \/>\n\tthe family is surviving for all these 18 years, as observed by the<br \/>\n\tHon&#8217;ble Supreme Court, there is no necessity to say  goodbye  to<br \/>\n\tthe normal rule of appointment and to show favour to petitioner at<br \/>\n\tthe cost of the interests of several others ignoring the mandate of<br \/>\n\tArticle 14. Even to direct the respondents to appoint the petitioner<br \/>\n\ton compassionate ground today i.e. after a period of 18 years on the<br \/>\n\tdeath of the employee would be against the object and purpose of<br \/>\n\tcompassionate appointment.  Under the circumstances, no direction<br \/>\n\tcan be issued directing the respondents to appoint the petitioner on<br \/>\n\tcompassionate ground after 18 years of the death of the deceased<br \/>\n\temployee.\n<\/p>\n<p>\tEven<br \/>\n\totherwise, considering the fact that the father of the petitioner<br \/>\n\twas serving as a workcharged labourer, the scheme for compassionate<br \/>\n\tappointment will not be applicable to the employees who was serving<br \/>\n\tas workcharged employee.\n<\/p>\n<p>\tThe<br \/>\n\tcontention on behalf of the petitioner that other employees who were<br \/>\n\tsering as workcharged, on their death  compassionate appointment are<br \/>\n\tgiven, is concerned admittedly  the scheme for compassionate<br \/>\n\tappointment would not be applicable to the workcharged employee.<br \/>\n\tMerely because some other persons have been granted benefits<br \/>\n\tillegally and\/or wrongly, the petitioner cannot claim similar<br \/>\n\tbenefit which is not  in accordance with law, there cannot be any<br \/>\n\tnegative discrimination.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, the present Special Civil Application deserves to<br \/>\n\tbe dismissed and is dismissed accordingly.
