The petitioner in the Election O.P.No.1 of 2001 is the petitioner<br \/>\nin I.A.No.76 of 2003.  She has filed the said Election O.P. to declare the<br \/>\nelection of the first respondent as Councilor in respect of Ward No.6<br \/>\nThiruvadanai Panchayat Union held on 16.10.2001 as incorrect and also declare<br \/>\nthat the petitioner was duly elected.  One of the main complaint in the Election<br \/>\nPetition was that 228 votes exercised in Booth No.71 in favour of the petitioner<br \/>\nwas taken into account in favour of the first respondent and this could be<br \/>\nproved only by production of the votes polled in Booth No.71.  The petitioner<br \/>\nhas also raised several other reasons for declaring the first respondent as the<br \/>\nsuccessful candidate in the election held on 16.10.2001 is not valid.\n<\/p>\n<p>\t\t3. The petitioner has filed an application in I.A.No.76 of 2003 for<br \/>\nproduction of votes polled in Booth No.71 of Orikkotai village, Thiruvadanai<br \/>\nPanchayat Union 6th Ward.  Her specific case in the said application was that in<br \/>\nBooth No.71, the total votes polled were 280, out of which petitioner has got<br \/>\n228 votes and the first respondent got 15 votes, the second respondent 32 votes<br \/>\nand 5 votes were invalid votes.  Her further case is that  228 votes exercised<br \/>\nin her favour was taken into account in favour of the first respondent and the<br \/>\nvotes which the first respondent got has been transferred to her account.  The<br \/>\nsaid application was resisted by the respondents stating that the production of<br \/>\nvotes will amount to recount of votes.  The learned Principal District Judge,<br \/>\nRamanathapuram dismissed the said application which has resulted in the<br \/>\npetitioner approaching this Court by way of the present Civil Revision Petition.\n<\/p>\n<p>\t\t5. Mr.V.Sitharanjandas, the learned counsel appearing for the<br \/>\npetitioner, has vehemently contended that the petitioner was declared elected on<br \/>\n21.10.2001 and she has been asked to approach the Thiruvadanai Panchayat Union<br \/>\non 22.10.2001 for getting certificate declaring her as the successful candidate.<br \/>\nWhile so, when she has visited union office on 22.10.2001, it has been stated<br \/>\nthat for obtaining consent, the papers have been circulated to the District<br \/>\nCollector and that she can come and collect the same on 23.10.2001.  While so,<br \/>\non 22.10.2001 it has been declared that the first respondent was elected as<br \/>\nCouncilor in respect of Ward No.6 of the said Panchayat Union.\n<\/p>\n<p>\t\t6. The counsel for the petitioner has further stated that even in<br \/>\nthe Election Petition, it has been stated that out of 280 votes polled in Ward<br \/>\nNo.71, the petitioner has secured 228 Votes.  Further, according to him,  it has<br \/>\nbeen stated in the election petition that the votes polled in her favour have<br \/>\nbeen taken into account in favour of the first respondent.  The learned counsel<br \/>\nhas further argued that if the vote polled in Ward No.71 is called for, the<br \/>\nentire truth will come out.    Thus, according to the learned counsel for the<br \/>\npetitioner, in the interest of justice, the application should have been ordered<br \/>\nby the learned Principal District Judge, Ramanathapuram.\n<\/p>\n<p>\t\t7. Per contra, Mr. P.T.S.Narendravasan, the learned counsel<br \/>\nappearing for the first respondent, has submitted that it is false to state that<br \/>\nthe votes which have been exercised in favour of the petitioner in Ward No.71<br \/>\nhave been wrongly included in the votes in favour of the first respondent.<br \/>\nFurther, according to the learned counsel for the first respondent, the prayer<br \/>\nfor recount has not been prayed for in the main Election Petition.  Thus,<br \/>\naccording to the learned counsel for the first respondent, the petition deserves<br \/>\nno merits and is liable to be dismissed.\n<\/p>\n<p>\t\t8. The learned Special Government Pleader (C.S.) appearing for the<br \/>\n3rd respondent has submitted that the petitioner has already filed an<br \/>\napplication in I.A.No.144 of 2002 to produce Form Nos.20, 22 and 23 and the same<br \/>\nhas been allowed by the learned Principal District Judge, Ramanathapuram and<br \/>\naccordingly, the 3rd respondent has already submitted Form Nos.20, 22 and 23 in<br \/>\nthe said Court and hence the present application is not maintainable.  Further,<br \/>\nit has been stated that since the petitioner in the main Election Petition has<br \/>\nnot prayed for recount of votes, the present application cannot be entertained.\n<\/p>\n<p>\t\t9. The learned Principal District Judge, Ramanathapuram, while<br \/>\ndismissing the application filed by the petitioner, has held that in the main<br \/>\nElection Petition, the petitioner has prayed only for declaration that she is<br \/>\nthe successful candidate and for further declaration to declare the election of<br \/>\nthe first respondent as invalid.  Hence, in the main Election Petition, the<br \/>\npetitioner has not sought for recount of votes.    Learned Principal District<br \/>\nJudge further held that the purpose behind the present petition is to recount<br \/>\nthe votes that have been utilised in Booth No.71 which cannot be permitted in<br \/>\nview of the fact that the relief of recount of votes has not been prayed in the<br \/>\nmain Election Petition.\n<\/p>\n<p>\t\t10. I have heard the arguments advanced on the side of both the<br \/>\npetitioner and the respondents.  It is true that the petitioner has not asked<br \/>\nfor recount of votes in her Election Petition.  But, as rightly pointed out by<br \/>\nthe learned counsel for the petitioner, in the main Election Petition, the<br \/>\npetitioner has specifically stated in paragraph 12 of the Election Petition,<br \/>\nthat out of 280 votes polled in Booth No.71, the petitioner has secured 228<br \/>\nvotes, the first respondent 15 votes, the second respondent 32 votes and invalid<br \/>\nvotes were 5 in numbers.  Again in paragraph 13, the petitioner has stated that<br \/>\nin Ward No.71, the votes secured by her have not been added in her account and<br \/>\nthe same have been added in the account of the first respondent.  It has been<br \/>\nfurther averred that in view of such malpractice, the first respondent was<br \/>\ndeclared as elected.  Thus, the petitioner has clearly averred in the main<br \/>\nElection Petition that she has secured 228 votes in Booth No.71.  While so, to<br \/>\nknow the real truth and in the interest of the justice, the application in<br \/>\nI.A.No.76 of 2003, which has been filed for direction directing the 3rd<br \/>\nrespondent to produce the votes registered in Booth No.71 cannot at any stretch<br \/>\nof imagination be called as unwarranted and unreasonable.  The reasoning of the<br \/>\nlearned Principal District Judge, Ramanathapuram that the petitioner did not ask<br \/>\nfor recount in the main Election Petition does not sound well.  If the<br \/>\npetitioner has not whispered about the votes secured by her in Booth No.71 and<br \/>\nher apprehension that the votes secured by her are added to the account of the<br \/>\nfirst respondent, it can well be said that the application filed by the<br \/>\npetitioner for direction directing the 3rd respondent to produce the votes<br \/>\nregistered in Booth No.71 cannot be entertained.\n<\/p>\n<p>\t\t11. It is no doubt true that recount is not to be ordered merely for<br \/>\nthe sake of asking or merely because the court is inclined to hold a recount.<br \/>\nIt is also true that the to permit or not to permit a recount is a question<br \/>\ninvolving jurisdiction of the Court.  But, when a specific plea has been raised<br \/>\nby the petitioner even in the main petition that 228 votes which she has secured<br \/>\nhave been transferred to the account of the first respondent with a mala fide<br \/>\nintention, the Court cannot shut its eyes and refuse to grant relief to secure<br \/>\nthe ends of justice.  Looking at any angle, the dismissal of the application<br \/>\nfiled by the petitioner is totally erroneous.\n<\/p>\n<p>\t\t12. Hence, the order of the learned Principal District Judge,<br \/>\nRamanathapuram dated 25.6.2003 in I.A.No.76 of 2003 in Election O.P.No.1 of 2001<br \/>\nis liable to be set aside and accordingly, the same is set aside.  The Civil<br \/>\nRevision Petition is allowed.
