Also     heard     counsel   representing       the<\/p>\n<p>State   of    Maharashtra.      Counsel    appearing   on     behalf   of<\/p>\n<p>respondent No.6 is supporting the claim of the appellant.<\/p>\n<p>        The    dispute     in     this     case     relates     to     the<\/p>\n<p>appointment of the Headmistress of Sant Shivram Maharaj<\/p>\n<p>Madhyamik     Vidyalaya,      Bhandara,     which    is a     recognized<br \/>\n<span class=\"hidden_text\">                                         -2-<\/span><\/p>\n<p>secondary       school       run        by     Swami      Vivekanand       Shikshan<\/p>\n<p>Sanstha, respondent no.1. The appellant was appointed as<\/p>\n<p>Headmistress of the school by respondent No.6 in the year<\/p>\n<p>2004.     Admittedly, prior permission for her appointment<\/p>\n<p>was not obtained from the competent authority and that<\/p>\n<p>alone is the reason for which the High Court found the<\/p>\n<p>appointment illegal and struck it down.<\/p>\n<p>        It    is     undeniable          that       the    appointment         of   the<\/p>\n<p>appellant as the Headmistress was made on the basis of an<\/p>\n<p>advertisement. It is also clear that at that time no<\/p>\n<p>other teacher in the school was eligible to be appointed<\/p>\n<p>as Headmistress. It is also not denied that later on the<\/p>\n<p>appellant&#8217;s        appointment          was       approved   by    the    competent<\/p>\n<p>authority.      We were also told that since her appointment<\/p>\n<p>the    appellant      is    working          as    the    Headmistress         in   the<\/p>\n<p>school.\n<\/p>\n<p>        Learned counsel appearing for the State admitted<\/p>\n<p>that    apart      from     the        fact       that    there    was    no    prior<\/p>\n<p>permission      for        the     appointment,           there     is    no    other<\/p>\n<p>irregularity          in         the     appellant&#8217;s             appointment         as<\/p>\n<p>Headmistress.\n<\/p>\n<p>        In those facts, we are of the view that the High<\/p>\n<p>court   was     in   error        in    interfering         in    the    matter     and<\/p>\n<p>setting aside the appellant&#8217;s appointment.<br \/>\n<span class=\"hidden_text\">                         -3-<\/span><\/p>\n<p>      We, accordingly, set aside the High Court order<\/p>\n<p>and confirm the appellant&#8217;s appointment to the post of<\/p>\n<p>Headmistress.\n<\/p>\n<p>      The appeals stand allowed accordingly.<\/p>\n<p>                                &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;J<br \/>\n                                (AFTAB ALAM)<\/p>\n<p>                                &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;J<br \/>\n                                (K.S.
