Parshuram Pottery Works Ltd. through its Managing Director<br \/>\npraying for vacating the ad-interim relief granted vide order dated<br \/>\n8th March 2010 (Coram: Honourable Mr. Justice HK<br \/>\nRathod, as he then was) in Special Civil Application Nos. 1835 of<br \/>\n2009, 9960 of 2009 and 1675 of 2009.   Learned Senior Advocate Mr. PC<br \/>\nKavina with Mr. G. Ramakrishnan, learned advocate for the applicant<br \/>\nsubmitted that the ad-interim relief is granted in terms of Para<br \/>\n7(c).  For ready reference, the same is quoted from Civil<br \/>\nApplication<br \/>\nNo. 11066 of 2011:\n<\/p>\n<p>&#8220;7(c)\t\tPending<br \/>\nthe hearing till the final disposal of this petition, be pleased to<br \/>\ngrant ad-interim relief in terms of restraining the<br \/>\nrespondents\u00a0herein from dealing with any kind of movable and<br \/>\nimmovable properties and\/or directing the respondent herein to<br \/>\nfurnish bank guarantee of the total amount due under the order dated<br \/>\n10.2.1999.&#8221;\n<\/p>\n<p>2.0\tThe<br \/>\nlearned senior advocate for the applicant submitted that as the<br \/>\napplicant is having a ready buyer and in the opinion of the<br \/>\napplicant, the property is fetching the reasonable price, these Civil<br \/>\nApplications are moved to see that the ad-interim relief is suitably<br \/>\nmodified or vacated so as to enable him to deal with the property.<br \/>\nThe learned learned senior advocate for the applicant submitted that<br \/>\nto take care of the interest of the respondent authority &#8211;<br \/>\noriginal petitioner, it is deemed proper by the applicant to file<br \/>\nUndertaking along with Bank Guarantee for an amount, which is<br \/>\nmentioned in the summary attached to every Undertaking filed in each<br \/>\nof the Civil Application.  In Civil Application No. 11066 of 2011,<br \/>\nthe amount mentioned is Rs.1,55,45,517\/- (Rupees One crore fifty five<br \/>\nlakh forty five thousand five hundred seventeen only).  In Civil<br \/>\nApplication No. 11082 of 2011 the amount mentioned is Rs.11,09,112\/-<br \/>\n(Rupees Eleven lakh nine thousand one hundred twelve only).  In Civil<br \/>\nApplication No. 11084 of 2011 the amount mentioned is Rs.7,40,028\/-<br \/>\n(Rupees Seven lakh forty thousand twenty eight only).  The<br \/>\nUndertakings are filed by Managing Director<br \/>\nMs. Saritaben A.\n<\/p>\n<p>Ganpule.\n<\/p>\n<p>3.0\tHaving<br \/>\nconsidered the fact situation of the case, the Court is of the<br \/>\nopinion that the ad-interim relief granted at the relevant time is<br \/>\nmodified to the effect that, &#8216;the respondent, on furnishing the Bank<br \/>\nGuarantees to the satisfaction of the concerned authority &#8211;<br \/>\nRegional Provident Fund Commissioner, it will be open for the<br \/>\nrespondent to deal with the property&#8217;.\n<\/p>\n<p>3.1\tAt<br \/>\nthe request of learned advocate Mr. Niral R. Mehta for the petitioner<br \/>\nin the aforesaid petitions, it is clarified that, this order of<br \/>\nmodifying \/ vacating ad-interim relief will be effective only after<br \/>\nfurnishing the Bank Guarantee to the satisfaction of the Regional<br \/>\nProvident Fund Commissioner for the amount mentioned herein above.<br \/>\nIt is also clarified that, this permission to deal with the property<br \/>\nis only with reference to the ad-interim relief granted by this Court<br \/>\nand it does not deal with or change any order passed by the competent<br \/>\nCourt against the respondent.\n<\/p>\n<p>3.2\tThe<br \/>\napplicant herein &#8211; original respondent is directed to keep<br \/>\nthese Bank Guarantees valid till the final disposal of these<br \/>\npetitions.\n<\/p>\n<p>4.0\tWith<br \/>\nthis, the Civil Applications are disposed of.
