SECRETARY REVENUE DEPTT; &amp; 2 -\nRespondent(s)\n \n\n=========================================================\nAppearance : \nMR\nNV GANDHI for\nPetitioner(s) : 1, \nMS MINI NAIR AGP for Respondent(s) : 1, \nNone\nfor Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned advocate for the petitioner.\n<\/p>\n<p>The<br \/>\n\tpetitioner, revisionist applicant before the respondent no.1, has<br \/>\n\tapproached this Court under Article 226 and 227 of the Constitution<br \/>\n\tof India, challenging the order dated 30.05.2011, passed by the<br \/>\n\trespondent no.1, rejecting the Revision Application, challenging the<br \/>\n\torder dated 03.04.2008, passed by the concerned Collector declining<br \/>\n\tto regularize the encroachment made by the petitioner on the<br \/>\n\tGovernment land.\n<\/p>\n<p>The<br \/>\n\tadmitted facts, as stated in the memo of the petition, would go to<br \/>\n\tshow that the petitioner is not having any title, right or<br \/>\n\tentitlement to remain on the land in question.  He is, in other<br \/>\n\twords, admittedly an encroacher upon the land.  The Counsel for the<br \/>\n\tpetitioner relying upon the Government Resolution dated 08.01.1980,<br \/>\n\tparticularly paragraph 6 of the resolution, contended that the<br \/>\n\tpetitioner derives his right from the said resolution for getting<br \/>\n\this encroachment regularized.\n<\/p>\n<p>This<br \/>\n\tCourt is of the view that the said submission was made before the<br \/>\n\tRevisional Authority and despite that the regularization was not<br \/>\n\tgranted.  The Court has perused the order impugned wherein, it is<br \/>\n\trecorded that the Mamlatdar, Nizar, and Taluka Development Officer,<br \/>\n\tNizar, made submission that for the landless labourers,<br \/>\n\tit was proposed to allot 100<br \/>\n\tsq. yards plot and for that one Shri Dayabhai Subhashbhai Patel&#8217;s<br \/>\n\tland was proposed to be acquired. But as the said land was<br \/>\n\tencumbered, it was<br \/>\n\tfound that the original owner was not agreeable. The land in<br \/>\n\tquestion is not capable of being regularized, as it was not falling<br \/>\n\tunder the provision of Government Resolution dated 08.01.1980.  The<br \/>\n\tauthority has also observed that the applicant-petitioner is already<br \/>\n\thaving agricultural land as<br \/>\n\twell as residential premises and the encroachment was deliberate and<br \/>\n\twith a view to grab the land in question and in that view of the<br \/>\n\tmatter, the Revision Application was rejected vide order dated<br \/>\n\t02.05.2011.  In my view, under Article 226 of the Constitution of<br \/>\n\tIndia, this Court would not exercise extraordinary jurisdiction in<br \/>\n\tfavour of the encroacher and hence the petition being bereft of<br \/>\n\tmerits and deserves rejection and it is accordingly rejected.
