Justice K.HEMA\n\n Dated :15\/07\/2010\n\n O R D E R\n                                K.HEMA, J.\n                             ------------------\n                        B.A. No.4224 of 2010\n                     ------------------------------------\n                Dated this the 15th day of July, 2010\n\n                               O R D E R\n<\/pre>\n<p>         This petition is for bail.\n<\/p>\n<p>      2. The alleged offence is under Section 379 r\/w 34 of Indian<\/p>\n<p>Penal Code.    According to prosecution, de facto complainant&#8217;s<\/p>\n<p>wife is running a textile shop. Petitioners (A1 to A6) came to the<\/p>\n<p>shop and selected four churidar sets. They left the shop stating<\/p>\n<p>that they will come back and pay the money.                  But, after<\/p>\n<p>petitioners left the shop, it was found that 29 churidar sets were<\/p>\n<p>missing from the shop. Petitioners committed theft of 29 churidar<\/p>\n<p>sets. The incident happened on 13\/06\/2010 at about 1 p.m.<\/p>\n<p>      3. Petitioners were arrested on 13\/06\/2010 and they are in<\/p>\n<p>custody for the past 33 days. This petition is not opposed. On<\/p>\n<p>hearing both sides, I am satisfied that bail can be granted to<\/p>\n<p>petitioners on conditions. Hence, the following order is passed :<\/p>\n<blockquote><p>           Petitioners shall be released on bail on their executing<\/p>\n<p>           a bond for Rs.50,000\/- (Rupees fifty thousand only)<\/p>\n<p>           each with two solvent sureties each for the like sum to<\/p>\n<p>           the satisfaction of the court concerned, on the<\/p>\n<p>           following conditions :<\/p>\n<blockquote><p><span class=\"hidden_text\">B.A. No.4224 of 2010                2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                  (i)   Petitioners    shall   report  before     the<br \/>\n                        Investigating Officer    on every alternate<br \/>\n                        day between 10 a.m. and 1 p.m. and co-<br \/>\n                        operate with investigation.\n<\/p><\/blockquote>\n<blockquote><p>                  (ii)  Petitioners shall not leave the limits of the<br \/>\n                        police station within which the crime is<br \/>\n                        registered,   except    for  compliance    of<br \/>\n                        condition no.1.\n<\/p><\/blockquote>\n<blockquote><p>                  (iii) Petitioners   shall   not    influence    or<br \/>\n                        intimidate any witness or tamper with the<br \/>\n                        evidence.\n<\/p><\/blockquote>\n<blockquote><p>                  (iv)  In case, petitioners      are    involved<br \/>\n                        in     any   similar offence, bail is liable<br \/>\n                        to be cancelled.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>             This petition is allowed.<\/p>\n<p>                                         K.
