Sr. Civil Judge, Ahmedabad<br \/>\n[Rural] at Navrangpura in L.A.R. Case Nos.691\/2003 to 695\/2003<br \/>\nwhereby, the said references were partly allowed.\n<\/p>\n<p>2.0\tThe<br \/>\nfacts in brief are that the appellant   State proposed to acquire<br \/>\nthe lands belonging to the respondent   claimants for the purpose<br \/>\nof constructing the Narmada Canal under the provisions of the Land<br \/>\nAcquisition Act, 1894. Notification u\/s. 4 of the said Act was<br \/>\npublished on 24\/08\/2000 and Notification u\/s. 6 was published on<br \/>\n30\/01\/2001. On completion of all the legal formalities, the S.L.A.O.,<br \/>\nby award dated 24\/07\/2002, granted compensation @ Rs.10.50 per sq.<br \/>\nmetre for the acquired lands.\n<\/p>\n<p>2.1\tBeing<br \/>\naggrieved by the said award, the claimants preferred applications<br \/>\nrequesting to refer the dispute to the competent Court for<br \/>\nadjudication, which, ultimately, culminated into references before<br \/>\nthe Court below.\n<\/p>\n<p>2.2\tThe<br \/>\nreference Court, after appreciating the evidence on record, partly<br \/>\nallowed the references by awarding additional compensation @<br \/>\nRs.103.40 per sq. metre, over the above the compensation awarded by<br \/>\nthe S.L.A.O. Against the said award, the appellant   State has<br \/>\napproached this Court by way of these appeals.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the appellant   State and perused the evidence<br \/>\non record. The lands in question are situated in the sim of Village :<br \/>\nKathwada, Taluka : Daskroi, District : Ahmedabad. In respect of some<br \/>\nadjoining lands situated in the same Village, this Court has awarded<br \/>\ntotal compensation of Rs.75.50 per sq. metre for the acquired lands<br \/>\nby a decision passed in First Appeal No.4870\/2007 and group matter<br \/>\ndecided on 04.08.2008. Therefore, the claimants in these appeals will<br \/>\nalso be entitled for the same amount, i.e. Rs.75.50 per sq. metre.<br \/>\nSince the S.L.A.O. has awarded compensation @ Rs.10.50 per sq. metre<br \/>\nfor the acquired lands, the claimants will be entitled for additional<br \/>\ncompensation @ Rs.65.00 per sq. metre.\n<\/p>\n<p>4.\tIn<br \/>\nthe result, the appeals are partly allowed. The impugned award of the<br \/>\nreference Court is modified to the extent that the claimants will be<br \/>\nentitled for additional compensation @ Rs.65\/- per sq. metre instead<br \/>\nof what has been awarded by the Court below. The rest part of the<br \/>\nimpugned award stands confirmed. The appeals stand disposed of<br \/>\naccordingly. No order as to costs. R &amp; P to be sent back to the<br \/>\ntrial Court concerned forthwith.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
