Justice K.R.UDAYABHANU\n\n Dated :23\/02\/2007\n\n O R D E R\n                            K.R.UDAYABHANU, J\n\n                         ---------------------------------------------\n\n                            CRL.R.P.No.788 of 2007\n\n                          ---------------------------------------------\n\n              Dated this the 23rd day of February, 2007\n\n\n\n\n\n\n                                         ORDER\n<\/pre>\n<p>       Revision   petitioner   stands   convicted  for   the   offence   under<\/p>\n<p>Section   138   of   the   Negotiable   Instruments   Act   and   sentenced,<\/p>\n<p>modified   by   the   appellate   court,     to   undergo   imprisonment   till<\/p>\n<p>the   rising   of   the   court   and   to   pay   fine   of     Rs.65,000\/-   to   the<\/p>\n<p>complainant  and in default, to undergo simple imprisonment for<\/p>\n<p>one   month   vide   Section   357(1)   of   Code   of   Criminal   Procedure<\/p>\n<p>and that out of the fine amount, complainant is entitled to get a<\/p>\n<p>sum of Rs.60,000\/-.\n<\/p>\n<\/p>\n<p>       2.     Counsel for the revision petitioner has only sought for<\/p>\n<p>modification of the sentence and time to make the payment.   In<\/p>\n<p>the circumstances, sentence is modified to imprisonment till the<\/p>\n<p>rising of the court and to pay compensation of Rs.60,000\/- to the<\/p>\n<p>complainant vide  Section  357(3)  of Code  of Criminal  Procedure<\/p>\n<p>and  in  default,   to  undergo   simple  imprisonment   for   a  period  of<\/p>\n<p>three months.   Revision petitioner is granted four months&#8217; time<\/p>\n<p>CRRP788\/2007                 Page numbers<\/p>\n<p>to pay  the amount of compensation.
