The<br \/>\n        suits  were filed for recovery of possession of buildings.<br \/>\n        Earlier the plaintiffs had filed  Rent  Control  Petitions<br \/>\n        for  recovery  of  possession  and  those  petitions  were<br \/>\n        disposed of by stating that the denial  of  title  by  the<br \/>\n        tenant  was  bonafide  and the plaintiffs were directed to<br \/>\n        file regular suits in civil court.  It is  on  that  basis<br \/>\n        that the present suits are filed.\n<\/p>\n<p>        \t2.   The  trial  court dismissed the suits finding<br \/>\n        that  the  plaintiffs  have  not  produced  the   required<br \/>\n        documents  and  the  case  set up by the plaintiffs is not<br \/>\n        established.  After filing these  appeals  the  appellants<br \/>\n        filed applications   for  amendment  of  plaints.    After<br \/>\n        hearing both sides this court allowed the applications and<br \/>\n        the amendment of plaints was carried out by  incorporating<br \/>\n        necessary amendment   in  the  respective  plaints.    The<br \/>\n        appellants also produced  large  number  of  documents  as<br \/>\n        additional evidence in the appeal.\n<\/p>\n<p>        \t3.  When these appeals came up for hearing I heard<br \/>\n        the learned counsel on both sides.  It is now agreed  that<br \/>\n        since  this  court  has  allowed  amendment of plaints the<br \/>\n        respective defendant has to be granted an opportunity  for<br \/>\n        filing  additional  written  statements  and therefore the<br \/>\n        suits have to be remanded to the  trial  court  for  fresh<br \/>\n        trial and   disposal.     The  application  for  receiving<br \/>\n        additional evidence is not opposed and therefore they  are<br \/>\n        accepted as  additional  evidence.    On  a reading of the<br \/>\n        affidavit in support of the petition to receive additional<br \/>\n        document I am satisfied that the conditions under Order 41<br \/>\n        Rule 27 of C.P.C.  are satisfied and  that  it  is  highly<br \/>\n        necessary  to  receive  these documents for a satisfactory<br \/>\n        and complete  disposal  of  the  suits.    Therefore   the<br \/>\n        petition is allowed.\n<\/p>\n<p>        \t4.  In these appeals since the plaints are amended<br \/>\n        the respective defendant has to be given an opportunity to<br \/>\n        file  additional written statements and further opportunty<br \/>\n        to produce  counter documents.  Further trial of the suits<br \/>\n        will also be required.  In  the  above  circumstances  the<br \/>\n        only  way  to  do justice between the parties is to remand<br \/>\n        the suits to the trial court.<br \/>\n        \tThese appeals are therefore allowed and the  suits<br \/>\n        are  remanded  to  the  trial  court  for  fresh trial and<br \/>\n        disposal.  Parties shall appear before the trial court  on<br \/>\n        15-2-2005.   Since  the suits are of the year 1994 and the<br \/>\n        plaintiffs are in the second round of litigation the trial<br \/>\n        court  may  dispose  of  the  suits  as  expeditiously  as<br \/>\n        possible and preferably within six months from the date of<br \/>\n        appearance of parties.
