Justice V.GIRI\n\n Dated :17\/12\/2008\n\n O R D E R\n                        V.GIRI, J.\n         -------------------------\n               W.P.(C).No.37323 of 2008\n         -------------------------\n        Dated this the 17th day of December, 2008.\n\n                      JUDGMENT\n<\/pre>\n<p>       Petitioner      was    a    participant    in  the<\/p>\n<p>competition for group dance held as part of the<\/p>\n<p>Kottayam East Sub District Kalolsavam.          One other<\/p>\n<p>team, which participated in the said item, was<\/p>\n<p>awarded the first place.      The petitioner challenged<\/p>\n<p>the same before the appellate committee. It was<\/p>\n<p>contended  that     the    stage    setting    was  quite<\/p>\n<p>inadequate. Some tables were arranged in a haphazard<\/p>\n<p>manner and the students participants were asked to<\/p>\n<p>perform the item on the said stage. It is further<\/p>\n<p>contended that the Judges were also not eligible to<\/p>\n<p>sit as Judges.   A perusal of Ext.P3 would show that<\/p>\n<p>the appeal preferred by the petitioner&#8217;s team was<\/p>\n<p>rejected. Learned counsel for the petitioner submits<\/p>\n<p>that the appellate committee has not considered any<\/p>\n<p>one of the grounds urged.       I would have considered<\/p>\n<p>this, had the petitioner produced a copy of the<\/p>\n<p>appeal.  The appeal preferred was in the prescribed<\/p>\n<p>form.  Unless the petitioner is able to substantiate<\/p>\n<p>that the contentions which are urged in the writ<\/p>\n<p>petition, were also urged in the appeal, it is not<\/p>\n<p>W.P.(C).NO.37323\/08<\/p>\n<p>                      :: 2 ::\n<\/p>\n<p>\npossible for this court to appreciate the contention<\/p>\n<p>that the appellate committee has failed to consider<\/p>\n<p>the appeal on merits.\n<\/p>\n<p>       2.  Further, the ground for interference in a<\/p>\n<p>matter of this kind, in proceedings under Article 226<\/p>\n<p>of the Constitution of India, are extremely narrow.<\/p>\n<p>The first contention taken up by the petitioner<\/p>\n<p>regarding the inadequacy of the stage would obviously<\/p>\n<p>have been applicable to the other teams also.     The<\/p>\n<p>second contention relates to the eligibility of the<\/p>\n<p>Judges. This is a matter for subjective satisfaction<\/p>\n<p>and unless there is any striking irregularity in the<\/p>\n<p>constitution of the Judges&#8217; panel, it would not be<\/p>\n<p>appropriate for this court to interfere with the<\/p>\n<p>assessment or relative merits by the Judges.<\/p>\n<p>       I find no merit in the writ petition.
