Raviraja Pandian, J. <\/p>\n<p> 1. The civil revision petitions are filed as against the orders  dated 12.2.2002 made in I.A.Nos.69 and 68 of 2002  in O.S.No.216 of 2000, which were filed for permission to file a reply statement to the written statement of the respondent and for reception of certain documents respectively.\n<\/p>\n<p>  2. On being resisted by the respondent herein, the application in I.A.No.69 of 2002 has been rejected and the application in I.A.No.68 of 2002 was allowed in part by the trial Court  by permitting the petitioner to file documents of items 3 to 20 and rejecting the application in respect of two items of documents viz., sale deed dated 8.7.1891 and patta pass book dated 30.11.1973 on the ground that if the petitioner is permitted to file a reply statement, there will be a possibility of change of cause of action and suit property was purchased on two different sale deeds and there is no averment in the plaint about the sale deed dated 8.7.1891. The correctness of the said orders are now put in issue in the present civil revision petitions.\n<\/p>\n<p> 3. I heard the learned counsel on either side and perused the materials on record.\n<\/p>\n<p> 4. The reasoning as given by the trial Court for rejecting certain documents and to file reply statement by the petitioner is not sustainable.  The objections raised by the respondent could very well be considered at the time of trial. On that short ground, the applications need not be rejected. It is open to the respondent  to file a rejoinder to the reply statement and also the very same objections raised now could be  raised at the time of hearing the suit.\n<\/p>\n<p> 5. In the light of the reasoning as stated above, the orders passed by the trial Court are set aside and the civil revision petitions allowed  by making it clear that it is open to the respondent to file his objections to the  reply statement and also any other objections to the documents sought to be filed at the time of trial. No costs.
