HEMA, J.\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n                      B.A. No. 484 of 2009\n        =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n           Dated this the 3rd day of February, 2009\n\n                           O R D E R\n<\/pre>\n<p>       Petition for bail.\n<\/p>\n<p>       2. The alleged offences are under sections 143, 147, 148,<\/p>\n<p>341, 323, 324, 308 &amp; 506(II) read with section 149 IPC.<\/p>\n<p>According to prosecution, petitioners (A1, A5, A6, A7 and A8)<\/p>\n<p>along with other accused formed themselves into an unlawful<\/p>\n<p>assembly armed with deadly weapons and assaulted de facto<\/p>\n<p>complainant and committed various offences.<\/p>\n<p>       3. Learned counsel for petitioners submitted that<\/p>\n<p>petitioners are in custody from 19-1-2009 onwards. The incident<\/p>\n<p>occurred on 18-1-2009.     Learned Public Prosecutor submitted<\/p>\n<p>that this is an offshoot of political rivalry and hence, stringent<\/p>\n<p>conditions may be imposed but he has no objection in granting<\/p>\n<p>bail.\n<\/p>\n<p>       4. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted to petitioners on conditions.<\/p>\n<p>       5. Hence, petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the learned<\/p>\n<p>Magistrate, on the following conditions:-<\/p>\n<p>             1)  Petitioners   shall    report  before   the<\/p>\n<p>BA 484\/09                      -2-\n<\/p>\n<blockquote><p>                Investigating Officer on every Monday,<\/p>\n<p><span class=\"hidden_text\">                Wednesday and Saturday between            10<\/span><\/p>\n<p>                a.m. and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote><p>          2) Petitioners shall not enter the limits of the<\/p>\n<p>                police station within which the crime is<\/p>\n<p>                registered   except     for  compliance   of<\/p>\n<p>                direction in condition (1).<\/p>\n<\/blockquote>\n<blockquote><p>          3) Petitioners shall not intimidate or influence<\/p>\n<p>                any witness or commit any offence while<\/p>\n<p>                on bail and in case breach of this<\/p>\n<p>                condition, bail is liable to be cancelled.<\/p>\n<p>     This petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                            K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.H.Hamza vs State Of Kerala on 3 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 484 of 2009() 1.
