Counsel for the respondent.\n\nBY THE COURT<\/pre>\n<p>             By the instant writ petition under Article 226 of the<\/p>\n<p>Constitution of India, the petitioner seeks a direction to the<\/p>\n<p>respondents to appoint him on the post of Teacher Gr.III.<\/p>\n<p>             Heard learned counsel for the parties.<\/p>\n<p>             It is contended by learned counsel for the petitioner<\/p>\n<p>that the petitioner&#8217;s father Shri Punam Chand Soni was Freedom<\/p>\n<p>Fighter    and    died   on   25.11.1991   and   the    petitioner   is<\/p>\n<p>unemployed, therefore, the petitioner is entitled for appointment<\/p>\n<p>under the Rajasthan Freedom Fighters Aid Rules, 1959 (for short<\/p>\n<p>&#8216;the Rules of 1959&#8217; hereinafter). Learned counsel for the<\/p>\n<p>petitioner has invited my attention to Rule 12 (5) of the Rules of<\/p>\n<p>1959.\n<\/p>\n<p><span class=\"hidden_text\">                            2<\/span><\/p>\n<p>  Rule 12 of the Rules of 1959 reads as under:-<\/p>\n<p>&#8220;12. Employment in Government Service<br \/>\netc.- (1) A person who lost Government<br \/>\nservice in the circumstances specified in clause\n<\/p>\n<p>(d) of Rule 3 will be eligible to re-employment<br \/>\nin Government service if he is below fifty-five<br \/>\nyears of age.\n<\/p>\n<p>(2)   Such     person      may     be    granted       with<br \/>\nretrospective effect from the date of the<br \/>\ntermination of his service such proportionate<br \/>\npension or gratuity or both as would have been<br \/>\nadmissible to him on that date according to the<br \/>\nRules to which he was then subject as if he<br \/>\nhad been compulsorily retired on and from that<br \/>\non grounds of ill health.\n<\/p>\n<p>(3) A civil pensioner            whose pension was<br \/>\nforfeited in any of the circumstances specified<br \/>\nin clause (d) of rule 3 will be restored his<br \/>\npension with retrospective effect from the date<br \/>\non which the forfeiture took effect.\n<\/p>\n<p>(4) Except as provided in sub-rule (5) no claim<br \/>\nfor   any    relief   under      this   rule   shall    be<br \/>\nentertained if made by any dependent, heir or<br \/>\nsuccessor of a political sufferer.\n<\/p>\n<p>(5) If a person who lost Government service in<br \/>\nthe circumstances specified in clause (d) of<br \/>\nrule 3 has since died or is more than fifty-five<br \/>\nyears of age or has become infirm and unfit for<br \/>\nGovernment service, the State Government<br \/>\nmay     provide       suitable      employment           in<br \/>\nGovernment       service    to    any    two   of      such<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>            person&#8217;s   dependents       or,   if   there   be   no<br \/>\n            dependent in existence to any one of his heirs<br \/>\n            if it is satisfied of the existence of acute<br \/>\n            distress for want of such employment.&#8221;<\/p>\n<p>                Sub-rule (5) of Rule 12 of the Rules of 1959 provides<\/p>\n<p>that   If   a    person   who   lost    Government         service   in   the<\/p>\n<p>circumstances specified in clause (d) of rule 3 has since died or<\/p>\n<p>is more than fifty-five years of age or has become infirm and<\/p>\n<p>unfit for Government service, the State Government may provide<\/p>\n<p>suitable employment in Government service to any two of such<\/p>\n<p>person&#8217;s dependents or, if there be no dependent in existence to<\/p>\n<p>any one of his heirs if it is satisfied of the existence of acute<\/p>\n<p>distress for want of such employment. Clause (d) of Rule 3 of<\/p>\n<p>the Rules of 1959 provides that loss of Government service by<\/p>\n<p>dismissal, discharge, forced resignation on grounds connected<\/p>\n<p>with political movement or for association with or participation in<\/p>\n<p>a political movement or on the grounds of association or<\/p>\n<p>relationship with a person participating in a political movement<\/p>\n<p>or engaged in any activity connected with political movement.<\/p>\n<p>In the instant case, admittedly the petitioner&#8217;s father was neither<\/p>\n<p>in Govt. service nor had lost the Govt. service by dismissal,<\/p>\n<p>discharge, forced resignation on grounds connected with political<\/p>\n<p>movement or for association with or participation in a political<\/p>\n<p>movement or on the grounds of association or relationship with a<br \/>\n<span class=\"hidden_text\">                                       4<\/span><\/p>\n<p>     person participating in a political movement or engaged in any<\/p>\n<p>     activity connected with political movement.    Thus, the condition<\/p>\n<p>     precedent for providing the employment under Rule 12 (5) of the<\/p>\n<p>     Rules of 1959 is not fulfilled. It may be that the petitioner&#8217;s<\/p>\n<p>     father was political worker and freedom fighter, however after<\/p>\n<p>     the Independence, he himself joined the Government service<\/p>\n<p>     and therefore, the question of loss of Govt. service by dismissal,<\/p>\n<p>     discharge, forced resignation on grounds connected with political<\/p>\n<p>     movement or for association with or participation in a political<\/p>\n<p>     movement or on the grounds of association or relationship with a<\/p>\n<p>     person participating in a political movement or engaged in any<\/p>\n<p>     activity connected with political movement, does not arise.<\/p>\n<p>     However, the petitioner applied for the post and competed, his<\/p>\n<p>     case was considered and was not found meritorious and in reply<\/p>\n<p>     the State came with a case that no person less meritorious than<\/p>\n<p>     the petitioner has been selected. Thus, it is not the case of the<\/p>\n<p>     petitioner that less meritorious person than the petitioner has<\/p>\n<p>     been selected. More so, the merit list came to an end on<\/p>\n<p>     31.03.1997 for the interviews for the Session 1996-97.<\/p>\n<p>                 In this view of the matter, I do not find any merit in<\/p>\n<p>     the writ petition. The writ petition is therefore, dismissed.
