The petitioner, claiming himself to be a resident  of<br \/>\n       Gram Panchayat Jamdi, Janpad Panchayat Jaijaipur, District<br \/>\n       Janjgir-Champa, has preferred this petition on the ground<br \/>\n       that a complaint was made by him on 06.12.2005 (Annexure<br \/>\n       P\/1) with regard to non-payment of amount of Rs. 10,000\/-<br \/>\n       under the Pradhanmantri Gramoday (Gramin Awas) Yojna, Year<br \/>\n       2003-2004 and various other complaints with regard to<br \/>\n       certain financial irregularities committed by the respondent<br \/>\n       No. 6. The respondent No. 6 was removed after enquiry by<br \/>\n       order dated 03.05.2006 (Annexure P\/5) but thereafter, he was<br \/>\n       reinstated in service by order dated 05.06.2006 (Annexure<br \/>\n       P\/6).\n<\/p>\n<p>2.   The question in this petition is asto whether the<br \/>\npetitioner has any locus to prefer this writ petition<br \/>\nseeking a writ of mandamus to quash the order of<br \/>\nreinstatement of respondent No. 6 and further, a direction<br \/>\nto enquire into the various complaints.\n<\/p>\n<p>3.   It is well settled that a writ is maintainable only at<br \/>\nthe instance of the aggrieved person\/party. The petitioner<br \/>\nmay be a resident of the same village and he might have<br \/>\nfiled a complaint, but he is not personally aggrieved by the<br \/>\norder of reappointment of the respondent No. 6. It is a case<br \/>\nof the petitioner that enquiry is still pending against the<br \/>\nrespondent No. 6 which has not culminated into exoneration.\n<\/p>\n<p>4.   Law is clear on the above point that no relief can be<br \/>\ngranted to a person who is not personally aggrieved by an<br \/>\norder or any action. It is well settled that person<br \/>\napproaching this Court must be `aggrieved person&#8217;. The writ<br \/>\npetition at the instance of third party is not maintainable<br \/>\nexcept in case of public interest litigation petition,<br \/>\nhabeas corpus or quo warranto.\n<\/p>\n<p>5.   The Supreme Court, in <a href=\"\/doc\/318991\/\">D.Nagaraj &amp; Others v. State of<br \/>\nKarnataka &amp; Others1,<\/a> observed as under:\n<\/p>\n<blockquote><p>                &#8220;7.   The   sole   question   that<br \/>\n                requires   to  be  determined   in<br \/>\n                these   appeals  is  whether   the<br \/>\n                appellants   could  maintain   the<br \/>\n                aforesaid writ petitions. It  does<br \/>\n                not   describe  the   classes   of<br \/>\n                persons    entitled    to    apply<br \/>\n                thereunder, the existence  of  the<br \/>\n                right   is   implicit   for    the<br \/>\n                exercise   of   the  extraordinary<br \/>\n                jurisdiction  by  the  High  Court<br \/>\n                under  the  said  Article.  It  is<br \/>\n                also   well  established  that   a<br \/>\n                person  who  is not  aggrieved  by<br \/>\n                the  discrimination complained  of<br \/>\n                cannot maintain a writ petition.&#8221;\n<\/p><\/blockquote>\n<p>  6.   Further, in <a href=\"\/doc\/1314973\/\">Vinoy Kumar v. State of U.P. &amp; Others2, the<br \/>\n       Supreme Court<\/a> observed as under:\n<\/p>\n<blockquote><p>                &#8220;2.  Generally speaking, a  person<br \/>\n                shall  have  no  locus  standi  to<br \/>\n                file a writ petition if he is  not<br \/>\n                personally   affected    by    the<br \/>\n                impugned  order or his fundamental<br \/>\n                rights  have neither been directly<br \/>\n                or  substantially invaded  nor  is<br \/>\n                there any imminent danger of  such<br \/>\n                rights   being  invaded   or   his<br \/>\n                acquired   interests   have   been<br \/>\n                violated  ignoring the  applicable<br \/>\n                rules.  The  relief under  Article<br \/>\n                226  of the Constitution is  based<br \/>\n                on  the  existence of a  right  in<br \/>\n                favour of the person invoking  the<br \/>\n                jurisdiction.  The  exception   to<br \/>\n                the  general rule is only in cases<br \/>\n                where  a  writ applied  for  is  a<br \/>\n                writ  of  habeas  corpus  or   quo<br \/>\n                warranto   or  filed   in   public<br \/>\n                interest.   It  is  a  matter   of<br \/>\n                prudence, that the court  confines<br \/>\n                the  exercise of writ jurisdiction<br \/>\n                to  cases  where  legal  wrong  or<br \/>\n                legal  injuries are  caused  to  a<br \/>\n                particular    person    or     his<br \/>\n                fundamental  rights are  violated,<br \/>\n                and  not  to  entertain  cases  of<br \/>\n                individual wrong or injury at  the<br \/>\n                instance  of  third  party   where<br \/>\n                there  is  an effective legal  aid<br \/>\n                organisation which can  take  care<br \/>\n                of such cases.&#8221;\n<\/p><\/blockquote>\n<p>  7.   The petitioner seeks a roving enquiry on the basis of<br \/>\n       certain allegations which cannot be granted in a writ<br \/>\n       jurisdiction. It is for the authorities to consider the<br \/>\n       complaint  of the petitioner and if so warrants,  the<br \/>\n       respondent authorities may take appropriate steps.\n<\/p>\n<p>8.   The Supreme Court, in Dharampur Sugar (Kashipur) Ltd.<br \/>\nv. State of Uttaranchal &amp; Others3, observed as under:\n<\/p>\n<blockquote><p>                &#8220;83.  It  is, therefore, necessary<br \/>\n                for   the   person   making   such<br \/>\n                allegations    to   supply    full<br \/>\n                particulars  in the  petition.  If<br \/>\n                sufficient      averments      and<br \/>\n                requisite  materials  are  not  on<br \/>\n                record,  the court would not  make<br \/>\n                &#8220;fishing&#8221; or roving enquiry&#8221;\n<\/p><\/blockquote>\n<p>  9.   Further,  in  <a href=\"\/doc\/1530123\/\">Kurapati Mariadas v. Dr. Ambedkar  Sewa<br \/>\n       Samajan &amp; Others4, the Supreme Court<\/a> observed as under:\n<\/p>\n<blockquote><p>                &#8220;It  seems that in this case,  the<br \/>\n                High  Court  has gone out  of  its<br \/>\n                way,  firstly  in relying  on  the<br \/>\n                xerox   copies  of   the   service<br \/>\n                record of the appellants and  then<br \/>\n                at   the   appellate   stage,   in<br \/>\n                calling   the   files    of    the<br \/>\n                Electricity   Board   where    the<br \/>\n                appellant   was   working.    This<br \/>\n                amounted to a roving enquiry  into<br \/>\n                the  caste of the appellant  which<br \/>\n                was  certainly not permissible  in<br \/>\n                writ jurisdiction.&#8221;\n<\/p><\/blockquote>\n<p>  10.  Applying  the  well-settled  principles  of  law   as<br \/>\n       aforestated to the facts of the case wherein the petitioner<br \/>\n       is  not personally aggrieved by reinstatement of  the<br \/>\n       respondent No. 6, and secondly, a roving enquiry cannot be<br \/>\n       directed under the garb of this petition, the petition is<br \/>\n       bereft of merit and is accordingly dismissed.
