Bhaya for petitioner and learned AGP<br \/>\nMs.Jirga Jhaveri for respondent No.2.\n<\/p>\n<p>2.<br \/>\n\tRespondent No.1, though served, has not engaged any advocate and no<br \/>\nappearance is filed on behalf of respondent No.1. However, Shri<br \/>\nAshokkumar M. Agarwal, Director of respondent No.1 Co. has filed<br \/>\naffidavit-in-reply on behalf of respondent No.1 Co. Copy thereof is<br \/>\nserved to learned advocate Ms.Lilu K. Bhaya but, it has not been<br \/>\nreceived by learned AGP Ms.Jirga Jhaveri.\n<\/p>\n<p>3.\tIn<br \/>\nthis matter, earlier on 13.9.2010, this Court has passed following<br \/>\norder :\n<\/p>\n<p> Heard<br \/>\nlearned Advocate Ms. Lilu K. Bhaya for petitioner. Respondent No.1<br \/>\nAshokkumar M. Agarwal has<br \/>\nfiled affidavit in reply which is placed on record.  When matter is<br \/>\ncalled out, he has not been found present in the Court though it has<br \/>\nbeen inquired by Court Shirastedar. However, in interest of justice,<br \/>\nmatter is adjourned to 30.9.2010. Meanwhile, ad interim relief<br \/>\ngranted earlier is extended till 30th<br \/>\nSeptember, 2010.\n<\/p>\n<p>4.\tThereafter,<br \/>\non 3.9.2010, this Court<br \/>\nhas passed following order :\n<\/p>\n<p> 1.\tMr.Ashokkumar<br \/>\nM. Agarwal, who is a Director of M\/s Gopal Fibers Private Limited has<br \/>\nfiled an affidavit in reply, which is on record and it is also<br \/>\nsupplied to Ms. Lilu K. Bhaya. Ms.Jirga Jhaveri is appearing on<br \/>\nbehalf of respondent No.2-State.\n<\/p>\n<p>2.\tRespondent<br \/>\nNo.1 &#8211; Ashokkumar M. Agarwal is not remained personally present and<br \/>\nno advocate is engaged by him, therefore, the matter is adjourned to<br \/>\n13.09.2010.\n<\/p>\n<p>3.\tMeanwhile,<br \/>\nad-interim relief granted by this Court on 28.07.2010 is extended<br \/>\ntill 13.09.2010.\n<\/p>\n<p>5.\tThis<br \/>\nbeing a third occasion where respondent No.1 &#8211; Ashokkumar M. Agarwal<br \/>\nis not present when the matter is taken up for hearing. In this<br \/>\nmatter, this Court has issued notice to respondents and at the time<br \/>\nof issuing notice, ad-interim relief in terms of Para.9(c) was<br \/>\ngranted. Thereafter, it has been extended from time to time.\n<\/p>\n<p>6.\tHowever,<br \/>\nconsidering the fact that there is consistent absence of respondent<br \/>\nNo.1 as referred above and  the question raised in present petition<br \/>\nby petitioner and also considering affidavit-in-reply filed by Shri<br \/>\nAshokkumar M. Agarwal, the question involved in present petition<br \/>\nrequires detailed examination.
