SHAH\n\t\t\n\t\n\n \n\nDate\n: 27\/01\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent application has been preferred by the applicant-original<br \/>\nappellant-original opponent no. 3-ICICI Lombard General Insurance<br \/>\nCompany Ltd. to stay further implementation, operation and execution<br \/>\nof the judgment and award passed by the learned Motor Accident Claims<br \/>\nTribunal (Auxiliary), Fast Track Court No. 2, Morbi dated 04\/06\/2010<br \/>\nin M.A.C.P. No. 280\/2006.\n<\/p>\n<p>2.\tWhile<br \/>\nissuing rule in the present application the learned Single Judge has<br \/>\npassed the following order on 16\/12\/2010;\n<\/p>\n<p>&#8220;RULE<br \/>\nreturnable on 25\/01\/2011.\n<\/p>\n<p>In<br \/>\nthe meantime, ad-interim stay of the impugned award on condition that<br \/>\nthe applicant shall deposit the entire awarded amount on or before<br \/>\nthe returnable date. On deposit of the amount, as directed by the<br \/>\nTribunal, 70% of the said amount shall be kept in Fixed Deposit<br \/>\nReceipt with a nationalized bank initially for a period of three<br \/>\nyears and on maturity shall be renewed by one year at a time without<br \/>\nany further orders in this regard till final disposal of the appeal.<br \/>\nThe F.D.R. Shall remain with the Nazir of the Tribunal. The quarterly<br \/>\ninterest accruing on such deposit shall be paid to the original<br \/>\nclaimants on regular basis.  As regards the 30% of the amount,<br \/>\nnecessary orders shall be passed on the returnable date.&#8221;\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Nanavati, learned advocate appearing on behalf of the<br \/>\napplicant and Shri Y.J. Patel, learned advocate appearing on behalf<br \/>\nof the original claimants, over and above 70% of the amount awarded<br \/>\nby the learned tribunal with proportionate cost and interest<br \/>\ndeposited in the Fixed Deposit in a nationalized bank, the learned<br \/>\ntribunal is further directed to invest  further 50% of the balance<br \/>\namount out of 30% with proportionate cost and interest in  Fixed<br \/>\nDeposit with a nationalized bank initially for a period of three<br \/>\nyears and on maturity the same shall be renewed from time to time.<br \/>\nThe original claimants shall be entitled to the periodical interest<br \/>\non the aforesaid Fixed Deposit and the Fixed Deposit shall remain<br \/>\nwith the Nazir of the learned tribunal.  The original claimants shall<br \/>\nbe entitled to withdraw the balance 15% amount awarded by the learned<br \/>\ntribunal  with proportionate cost and interest, which the learned<br \/>\ntribunal is directed to pay to the original claimants by an account<br \/>\npayee cheque on proper verification.  However, the aforesaid shall be<br \/>\nwithout prejudice to the rights and contention of the respective<br \/>\nparties in the main First Appeal and subject to the ultimate outcome<br \/>\nof First Appeal No. 4609\/2010.\n<\/p>\n<p>4.\tWith<br \/>\nthis, the present application is allowed.  Rule is made absolute to<br \/>\nthe aforesaid extent.
