Justice M.SASIDHARAN NAMBIAR\n\n Dated :15\/09\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n            CRL.M.C.NO.3811 OF 2010\n           ---------------------------------------------\n           Dated 15th          September, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>             By       Annexure-A1                order    learned<\/p>\n<p>Sessions Judge, Ernakulam granted bail to<\/p>\n<p>the petitioner on conditions.                             Offences<\/p>\n<p>alleged are under Sections 406, 419 and 420<\/p>\n<p>of Indian Penal Code. One of the conditions<\/p>\n<p>was that petitioner shall appear before the<\/p>\n<p>Sub Inspector of Police, Kallorkad Police<\/p>\n<p>Station   between 9 and 11 a.m on all<\/p>\n<p>Mondays and Thursdays. Petition is filed<\/p>\n<p>under  Section       482        of       Code        of  Criminal<\/p>\n<p>Procedure    to          delete             that         condition<\/p>\n<p>contending that           final report has already<\/p>\n<p>been submitted and taken cognizance and<\/p>\n<p>therefore, it is not necessary to continue<\/p>\n<p>the said condition.\n<\/p>\n<p>Crmc 3811\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>            2.   Learned  counsel appearing for the<\/p>\n<p>petitioner and learned Public Prosecutor       were<\/p>\n<p>heard.\n<\/p>\n<p>            3. Annexure-A2  final report shows that<\/p>\n<p>Sub Inspector of Police had already laid charge<\/p>\n<p>before       Judicial   First  Class   Magistrate&#8217;s<\/p>\n<p>Court-I, Muvattupuzha       and cognizance has been<\/p>\n<p>taken for the offences under Sections 406, 419<\/p>\n<p>and 420 of Indian Penal Code.         The condition<\/p>\n<p>directing the petitioner to appear before the<\/p>\n<p>Investigating Officer was passed at a time when<\/p>\n<p>investigation        was    pending.    When    the<\/p>\n<p>investigation      is over and a final report was<\/p>\n<p>submitted and offences were taken cognizance by<\/p>\n<p>the     learned Magistrate as C.C.385\/2010, it is<\/p>\n<p>not in the interest of justice to continue the<\/p>\n<p>said condition as no purpose will be served by<\/p>\n<p>the        petitioner    appearing    before    the<\/p>\n<p>Crmc 3811\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>Investigating      Officer  twice   in  a  week   as<\/p>\n<p>directed in Annexure-A1 order.<\/p>\n<p>            Petition is allowed.
