Balachandran, J.\n            ---------------------------\n             C.M.Appl.No.565 of 2005 &amp;\n               R.S.A.No.872 of 2005\n            ---------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    This Regular Second Appeal is posted before me<\/p>\n<p>in the defect list as no steps are taken for<\/p>\n<p>service  being  completed   in  C.M.Appl.No.565\/05,<\/p>\n<p>despite returning of notices issued to respondents<\/p>\n<p>1 and 2 unserved with the report that they have<\/p>\n<p>expired. This Court, vide order dated 2.4.2008,<\/p>\n<p>granted two weeks time to the appellants to cure<\/p>\n<p>the defects.  However, even as on today, no steps<\/p>\n<p>are taken to implead the legal representatives of<\/p>\n<p>deceased respondents 1 and 2.\n<\/p>\n<p>    2. C.M.Appl.No.565\/05 is an application seeking<\/p>\n<p>for condonation of delay of 2069 days in filing the<\/p>\n<p>appeal.   On going through the averments in the<\/p>\n<p>affidavit filed by the first appellant in support<\/p>\n<p>of the C.M. application, I am not satisfied that<\/p>\n<p>grounds or just and sufficient cause exist to<\/p>\n<p>condone the delay of as much as 2069 days in filing<\/p>\n<p><span class=\"hidden_text\">RSA 872\/05                2<\/span><\/p>\n<p>the appeal. No purpose also would be served even in<\/p>\n<p>the event of the legal representatives of deceased<\/p>\n<p>respondents 1 and 2 also being impleaded.     Hence,<\/p>\n<p>there is no necessity to grant any further time to<\/p>\n<p>cure the defects.\n<\/p>\n<p>     In the result, I dismiss this C.M.
