Mukherjee<br \/>\n\t     Hon&#8217;ble Mr.Justice S.Saghir Ahmad<br \/>\nI.G.Shah,  V.N.Ganpule,\t Sr.Advs.,  A.M.Khanwilkar,  Kailash<br \/>\nVasdev, (D.M.Nargolkar) Adv. for S.M.Jadhav, Adv.\/Advs. with<br \/>\nthem for the appearing parties.\n<\/p>\n<p>\t\t      J U D G M E N T<br \/>\n     The following Judgment of the Court was delivered:\n<\/p>\n<p>\t\t      J U D G M E N T<br \/>\nMUKHERJEE,J.\n<\/p>\n<p>     The 6  appellants before us and 5 others were arraigned<br \/>\nbefore the  Additional Sessions\t Judge, Thane  for  rioting,<br \/>\natternpting to\tcommit murder  and other  related  offences.<br \/>\nThe trial ended in convictions of all of them under Sections<br \/>\n148, 324\/149,  324\/149 I.P.C.  and  sentences  of  different<br \/>\nterms of  imprisonment.\t  In appeal, the High Court affirmed<br \/>\ntheir convictions  but reduced\tthe sentences  to the period<br \/>\nalready undergone  and imposed a fine of Rs.250\/- each.\t The<br \/>\nabove judgment\tof the High Court is under challenge in this<br \/>\nappeal.\n<\/p>\n<p>2.   According to  the prosecution  on June 24, 1978 between<br \/>\n7.00 and  7.30 A.M.  the accused  persons formed an unlawful<br \/>\nassembly armed\twith swords, spears, iron rods and sticks in<br \/>\nvillage Arwali\twith the common object of assaulting Tukaram<br \/>\n(P.W.2), Ballaram  (P.W.3), Gajana  (P.W.4), Vasant (P.W.5),<br \/>\nAnkush (P.W.6),\t Nagubal  (P.W.7),  Ganpat  (P.W.8)  and  of<br \/>\nattempting to  commit the  murder of Pundalik (P.W.9) and in<br \/>\nprosecution  of\t the  said  common  object  used  force\t and<br \/>\nviolence against all of them.\n<\/p>\n<p>3.   The defence  of the accused persons was that it was the<br \/>\ncomplainant party  which attacked  them with various weapons<br \/>\nas a  result of\t which one  of them,  namely, Haribhau\tdied<br \/>\nwhile others  sustained injuries.  According to the defence,<br \/>\nto save their skin they filed a false case against them.\n<\/p>\n<p>4.   On consideration  of the evidence adduced during trial,<br \/>\nthe trial Court held that the incident did not take place in<br \/>\nthe manner  alleged by the prosecution witnesses.  The trial<br \/>\nCourt further  held that having regard to the injuries found<br \/>\non the persons of the accused and the fact that one of them,<br \/>\nnamely, Haribhau  succumbed to\tthe injuries,  it was  clear<br \/>\nthat there was a free fight between the two groups, each one<br \/>\ncoming armed  with weapons.   The  trial Court observed that<br \/>\nevery prosecution witness tried to feign ignorance about the<br \/>\ninjuries sustained  by some  of the appellants and about the<br \/>\ncause of  death of  Haribhau.\t It  then  referred  to\t the<br \/>\njudgment of  this Court\t in Lakshmi Singh Vs. State of Bihar<br \/>\n[AIR 1976 Supreme Court 2263] and concluded as under:\n<\/p>\n<blockquote><p>     &#8220;If these principles are applied to<br \/>\n     the facts\tof the\tpresent case, it<br \/>\n     can be  said that\tthe  prosecution<br \/>\n     has  suppressed   he  genesis   and<br \/>\n     origin of\tthe occurrence\tand  has<br \/>\n     not presented  the true  version as<br \/>\n     to how  the incident  started.   It<br \/>\n     can  equally   be\tsaid   that  the<br \/>\n     prosecution witnesses  are\t telling<br \/>\n     lies on material points.&#8221;\n<\/p><\/blockquote>\n<p>5.   In our considered view, with the above observations and<br \/>\nfindings, the  trial Court  was\t not  at  all  justified  in<br \/>\nconvicting the\tappellants for\trioting\t or  for  the  other<br \/>\noffences  with\t the  aid  of  Section\t149  I.P.C.  Equally<br \/>\nuntenable is  the High\tCourt&#8217;s\t affirmation  of  the  above<br \/>\nconvictions for\t the evidence  on record clearly establishes<br \/>\nthe findings  recorded by  the trial  Court.  Once the trial<br \/>\nCourt found  that there\t was a sudden and free fight between<br \/>\nthe two groups in which members of both the groups sustained<br \/>\ninjuries, the trial Court should have held that there was no<br \/>\nscope for  convicting members  of one  of those groups under<br \/>\nSections  147  or  1481\t I.P.C.\t and  for  that\t matter\t for<br \/>\nsubstantive offences  with the aid of Section 149 I.P.C.  In<br \/>\nsuch a\tcase, the  accused persons would be liable for their<br \/>\nindividual acts and would not be liable vicariously.  In the<br \/>\ninstant case,  we are  unable to  convict the appellants for<br \/>\ntheir individual  acts also  as no specific evidence was led<br \/>\nby the prosecution in that regard.\n<\/p>\n<p>4.
