SHETH for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/06\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tMr.\n<\/p>\n<p>Sheth learned advocate has appeared and submitted that he has<br \/>\nreceived instruction to appear on behalf of the claimant in all the<br \/>\napplications and appeals. He has also submitted that he will enter<br \/>\nhis appearance on behalf of the original claimant on or before 18th<br \/>\nJune 2010 and complete the office formalities before 18th<br \/>\nJune 2010.\n<\/p>\n<p>2.\tRule.\n<\/p>\n<p>Mr. Sheth learned advocate waives service of notice of rule on behalf<br \/>\nof the opponent. At the request of Mr. U.A. Trivedi learned<br \/>\nAdditional Government Pleader and with the consent of Mr. Sheth<br \/>\nlearned advocate for the claimant the application is taken up for<br \/>\nhearing and final disposal today.\n<\/p>\n<p>3.\tThe<br \/>\npresent applications have been taken out seeking condonation of delay<br \/>\nof 356 days in filing the appeal against the award dated 11th<br \/>\nAugust 2008 in Reference Case Nos. 1129 to 1134 of 2001.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Sheth learned advocate for the original claimant has submitted that<br \/>\nhe has no objection if the delay is condoned.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe submission made by the learned Counsel and the averment made in<br \/>\nthe application, the relief prayed for in paragraph 5(a) is granted.<br \/>\nThe delay of 356 days in filing the appeal is condoned. The<br \/>\napplications are allowed. Rule is made absolute. No order as to cost.\n<\/p>\n<p>6.\tMr.\n<\/p>\n<p>Sheth learned advocate for the claimant has submitted that the<br \/>\ndispute raised in the appeal is covered by the judgment of this Court<br \/>\nand he has the entire compilation ready which he will supply to the<br \/>\nlearned Additional Government Pleader on or before 16th<br \/>\nJune 2010. In view of the fact that the issue raised in the appeals<br \/>\nis covered, Mr. Sheth learned advocate has requested that the appeal<br \/>\nmay be listed for hearing on 21st June 2010.
