The dispute is of civil nature and the<br \/>\n\tcomplainant has filed criminal complaint so as to pressurize the<br \/>\n\tapplicant. He also submitted that co-accused have been released by<br \/>\n\tthis Court. He also submitted that from the bare reading of the FIR,<br \/>\n\tit appears that there is no role attributed to the applicant. He<br \/>\n\tprayed to grant anticipatory bail to the applicant.\n<\/p>\n<p>Learned<br \/>\n\tAPP Ms.Shah strongly opposed the application of the applicant and<br \/>\n\tsubmitted that the applicant is involved in serious offence and<br \/>\n\ttherefore, he may not be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned Counsel for the parties. Learned Counsel for the parties do<br \/>\n\tnot press for further reasoned order.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case and the<br \/>\n\tco-accused have been released by this Court vide order dated<br \/>\n\t4.3.2011 passed in Criminal Misc. Application No.2392 of 2011 and<br \/>\n\torder dated 15.3.2011 passed in Criminal Misc. Application No.3339<br \/>\n\tof 2011, I am inclined to grant anticipatory bail to the applicant.<br \/>\n\tThis Court has also taken into consideration the law laid down by<br \/>\n\tthe Apex Court in the case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa<br \/>\n\tMhetre v. State of Maharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC<br \/>\n\t694, wherein the Apex<br \/>\n\tCourt reiterated the law laid down by the Constitutional Bench in<br \/>\n\tthe case of Shri Gurubaksh Singh Sibbia &amp; Ors.<br \/>\n\tReported in [1980]2 SCC 565.\n<\/p>\n<p>\tIn<br \/>\n\tthe event of arrest of the applicant in connection with CR No.I-245<br \/>\n\tof 2010 registered with Rajkot Taluka Police Station for the<br \/>\n\toffences alleged against him, he shall be released on bail on<br \/>\n\texecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\n\tsurety of the like amount on the following conditions that he shall:\n<\/p>\n<p>a)\tco-operate<br \/>\nwith the investigation and make\thimself available whenever required;\n<\/p>\n<p>b)\tremain<br \/>\npresent before the Investigating\tOfficer, Rajkot Taluka Police Police<br \/>\nStation on 18th  \tNovember, 2011 at 11.00<br \/>\nam.;\n<\/p>\n<p>c)\tnot<br \/>\nhamper the investigation in any manner nor\tshall directly or<br \/>\nindirectly make any inducement,\tthreat or promise to any witness so<br \/>\nas to\tdissuade them for disclosing such facts to the\tCourt or to any<br \/>\nPolice Officer;\n<\/p>\n<p>d)\tat<br \/>\nthe time of execution of bond, he shall furnish\this address to the<br \/>\nInvestigating Officer and the\tCourt concerned and shall not change<br \/>\nthe\tresidence till the final disposal of the case or till\tfurther<br \/>\norders;\n<\/p>\n<p>\te)\tnot<br \/>\n\tleave India without the permission of the\tCourt and, if is holding a<br \/>\n\tPassport, surrender the\tsame before the trial \tCourt immediately;\n<\/p>\n<p>\tIt<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand if he considers it proper and just; and the competent<br \/>\n\tCourt would decide it on merits.\n<\/p>\n<p>\tAt<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
