State.\n<\/p>\n<p>2.\tHeard<br \/>\nthe learned advocate for the applicant and learned APP for the<br \/>\nrespondent ?  State.\n<\/p>\n<p>3.\tThis<br \/>\napplication is filed by the applicant under Sec. 439 of Cr.P.C. for<br \/>\nreleasing him on regular bail in connection with the offence<br \/>\nregistered vide CR No.II-77\/2008 with Aslali Police Station for the<br \/>\noffences punishable under Sections 25 (1-b) (a) and 27 of the Arms<br \/>\nAct.\n<\/p>\n<p>4.\tThe<br \/>\nlearned advocate for the applicant has submitted that the applicant<br \/>\nis innocent and he is falsely involved in this case. He read the<br \/>\norder passed by the trial court and prayed to release the applicant<br \/>\non regular bail.\n<\/p>\n<p>5.\tAs<br \/>\nagainst this, learned APP, Mr.Maulik Nanavati, has strongly opposed<br \/>\nthis application and read the order passed by the trial court.\n<\/p>\n<p>6.\tI<br \/>\nhave gone through the order passed by the trial court as well as the<br \/>\npapers produced on record of the case. Looking to the allegations<br \/>\nlevelled against the applicant, I am inclined to release him on<br \/>\nregular bail.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocates for the parties do not press for reasoned order.\n<\/p>\n<p>8.\tConsidering<br \/>\nthe facts and circumstances of the case, the present application is<br \/>\nallowed. The applicant is ordered to be released on regular bail in<br \/>\nconnection with CR No.II-77\/2008 registered with Aslali Police<br \/>\nStation, Ahmedabad (Rural) on his executing personal bond in the sum<br \/>\nof Rs.5,000\/- (Rs. Five Thousand only) with one surety of the like<br \/>\namount to the satisfaction of the trial court and subject to the<br \/>\nconditions that he shall;\n<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of his liberty or  abuse his liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)<br \/>\nsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>(d)<br \/>\nnot leave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe present address of his residence to the I.O., and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>(f)<br \/>\nmark his presence before the concerned Police Station twice in a<br \/>\nmonth, that is, on 16th &amp; last day of each month between 11.00am<br \/>\nto 2.00pm till framing of charge;\n<\/p>\n<p>(g)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>9.\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>10.<br \/>\n If breach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>11.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>12.\tAt<br \/>\nthe time of trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>13.\tRule<br \/>\nis made absolute to the aforesaid extent.
