Justice P.S.GOPINATHAN\n\n Dated :25\/03\/2010\n\n O R D E R\n                    P.S.GOPINATHAN, J.\n\n                   = = = = = = = = = = = = =\n                   Crl.R.P.No.3703 of 2008.\n                   = = = = = = = = = = = = =\n\n           Dated this the 25th day of March, 2010.\n\n                         O R D E R\n<\/pre>\n<p>     The revision petitioner was found guilty for offence<\/p>\n<p>under Section 138 of the Negotiable Instruments Act and<\/p>\n<p>sentenced to simple imprisonment for three months with<\/p>\n<p>direction to pay Rs.59,850\/- as compensation and Rs.1,000\/-<\/p>\n<p>as costs to the first respondent, who prosecuted the revision<\/p>\n<p>petitioner before the Judicial Magistrate of the First Class-<\/p>\n<p>II, Aluva,   in CC.No.172\/2004.      Feeling aggrieved, the<\/p>\n<p>revision petitioner took up the matter in Crl.Appeal<\/p>\n<p>No.60\/2007 before the Sessions Judge, Ernakulam.         The<\/p>\n<p>IIIrd Addl.Sessions Judge to whom the appeal was made<\/p>\n<p>over concurred with the lower court in finding the revision<\/p>\n<p>petitioner guilty. However, the substantial sentence was<\/p>\n<p>reduced to imprisonment till the rising of the court and a<\/p>\n<p>fine of Rs.one lakh, out of which Rs.98,000\/- was ordered to<\/p>\n<p>be paid to the first respondent as compensation under<\/p>\n<p>Crl.R.P.No.3703 of 2008.\n<\/p>\n<p><span class=\"hidden_text\">                             -: 2 :-<\/span><\/p>\n<p>Sec.357(1) of the Criminal Procedure Code. Assailing the<\/p>\n<p>legality, correctness and propriety of the above conviction<\/p>\n<p>and sentence as modified in appeal, this revision petition<\/p>\n<p>was filed.\n<\/p>\n<p>      2.    The learned counsel for the revision petitioner<\/p>\n<p>submitted that he is not assailing the conviction as well as<\/p>\n<p>the substantial sentence but, he is assailing only the fine<\/p>\n<p>imposed.      According to the learned counsel, the fine<\/p>\n<p>imposed is too high and that the appellate court fixed the<\/p>\n<p>fine amount on calculating interest.          Appeal against<\/p>\n<p>conviction is not an execution proceedings of a civil court<\/p>\n<p>decree to calculate interest precisely and to determine the<\/p>\n<p>fine amount. In a criminal case, what is appropriate is to<\/p>\n<p>give a reasonable compensation and nothing more. Though<\/p>\n<p>the fine imposed is within the statutory limit, taking into<\/p>\n<p>account that the cheque amount was only for Rs.59,850\/-, I<\/p>\n<p>find that there is a little merit in the submission and that a<\/p>\n<p>fine of Rs.75,000\/- and paying that much amount as<\/p>\n<p>Crl.R.P.No.3703 of 2008.\n<\/p>\n<p><span class=\"hidden_text\">                             -: 3 :-<\/span><\/p>\n<p>compensation would meet the ends of justice. In the event<\/p>\n<p>the first respondent has more claim including interest, she<\/p>\n<p>would be at liberty to approach the civil court.<\/p>\n<p>      3.    In the result, while confirming the conviction and<\/p>\n<p>the substantial sentence, the fine is reduced to Rs.75,000\/-<\/p>\n<p>(Rupees seventy-five thousand only) with a default sentence<\/p>\n<p>of simple imprisonment for two months.           The revision<\/p>\n<p>petitioner is granted two months time to remit the fine<\/p>\n<p>which on realisation shall be paid to the first respondent as<\/p>\n<p>compensation under Sec.357(1) of the Crl.P.C.         Till the<\/p>\n<p>expiry of time to remit the fine, the bail bond executed by<\/p>\n<p>the revision petitioner shall remain in force.
