(J)\n\nCITATION:\n 1995 SCC  (1) 198\t  JT 1995 (1)\t223\n 1994 SCALE  (4)676\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t   ORDER\n<\/p>\n<p>1.This\tappeal by special leave arises against the  judgment<br \/>\nand  decree  of the Delhi High Court in RFA No. 59  of\t1978<br \/>\ndated 26-2-1979.  The plaintiff appellant filed the suit for<br \/>\ndeclaration  that  she\tis  the absolute  owner\t and  is  in<br \/>\npossession  of the house bearing old Municipal No. 5925\t and<br \/>\nnew  Municipal No. 4477, Ward No. XI, situated at  Plot\t No.<br \/>\n7\/18, Darya Ganj, Delhi.  She claimed to have purchased\t the<br \/>\nproperty from one Kaushalya Devi under a sale deed dated 11-<br \/>\n5-1946 registered on 29-5-1946 and thereby she is said to be<br \/>\nthe owner.  Shri Ratti Ram had no right title or interest to<br \/>\nalienate the property by the sale deed dated 29-1-1947 which<br \/>\nwas  said  to have been executed to stifle  the\t prosecution<br \/>\nintended  to  be  lodged  against  him.\t  The  trial   court<br \/>\ndismissed the suit.  On appeal, the High Court confirmed it.\n<\/p>\n<p>2.The question is whether the suit is within limitation.  In<br \/>\nthe evidence, it was admitted that she had knowledge of\t the<br \/>\nexecution  and registration of the sale deed  on  29-1-1947.<br \/>\nInitially  a  suit was filed in 1959 but  was  dismissed  as<br \/>\nwithdrawn with liberty to file fresh suit.  Admittedly,\t the<br \/>\npresent\t  suit\twas  filed  on\t30-7-1966.   The   question,<br \/>\ntherefore,  is\twhether\t the  suit  is\twithin\t limitation.<br \/>\nArticle\t 59  of the Schedule to the  Limitation\t Act,  1963,<br \/>\nrelied\ton  by\tthe appellant herself,\tpostulates  that  to<br \/>\ncancel\tor  set\t aside an instrument or decree\tor  for\t the<br \/>\nrescission of a contract, the limitation is three years\t and<br \/>\nit  begins  to run when the plaintiff entitles to  have\t the<br \/>\ninstrument or the decree cancelled or set aside or when\t the<br \/>\ncontract rescinded first became known to him.  As seen, when<br \/>\nthe  appellant had knowledge of it on 29-1-1949\t itself\t the<br \/>\nlimitation began to run from that date and the three  years&#8217;<br \/>\nlimitation  has hopelessly been barred on the date when\t the<br \/>\nsuit  was  filed.  It is contended by  Shri  VM.   Tarkunde,<br \/>\nlearned\t Senior Counsel for the appellant, that the  counsel<br \/>\nin the trial court was not right in relying upon Article 59.<br \/>\nArticle\t 113 is the relevant article.  The  limitation\tdoes<br \/>\nnot begin to run as the sale deed document is void as it was<br \/>\nexecuted  to  stifle the prosecution.  Since  the  appellant<br \/>\nhaving\tbeen  remained in possession, the  only\t declaration<br \/>\nthat  could be sought and obtained is that she is the  owner<br \/>\nand  that the document does not bind the appellant.  We\t are<br \/>\nafraid\tthat we cannot agree with the learned  counsel.\t  As<br \/>\nseen, the recitals of the documents would show that the sale<br \/>\ndeed  was executed for valuable consideration  to  discharge<br \/>\npre-existing  debts and it is a registered document.   Apart<br \/>\nfrom the prohibition under Section 92 of the Evidence Act to<br \/>\nadduce oral evidence to contradict the terms of the  recital<br \/>\ntherein, no issue in this behalf on the<br \/>\n<span class=\"hidden_text\">200<\/span><br \/>\nvoidity\t of the sale deed or its binding nature\t was  raised<br \/>\nnor  a\tfinding recorded that the sale deed  is\t void  under<br \/>\nSection\t 23  of the Contract Act.  Pleading  itself  is\t not<br \/>\nsufficient.   Since  the appellant is seeking  to  have\t the<br \/>\ndocument  avoided or cancelled, necessarily,  a\t declaration<br \/>\nhas  to\t be given by the court in that\tbehalf.\t  Until\t the<br \/>\ndocument is avoided or cancelled by proper declaration,\t the<br \/>\nduly  registered  document  remains  valid  and\t binds\t the<br \/>\nparties.   So  the suit necessarily has to  be\tlaid  within<br \/>\nthree  years  from  the date when the cause  of\t action\t had<br \/>\noccurred.   Since  the cause of action had arisen  on  29-1-<br \/>\n1947,  the  date  on which the sale deed  was  executed\t and<br \/>\nregistered and the suit was filed on 30-7-1966, the suit  is<br \/>\nhopelessly   barred  by\t limitation.   The   courts   below,<br \/>\ntherefore, were right in dismissing the suit.
