It is submitted by learned<br \/>\nadvocates for the respective parties that order dated 26.08.2011<br \/>\npassed by this Court be modified to some extent.\n<\/p>\n<p>[2]\t\tThis<br \/>\nCourt on 26.08.2011 passed following order : &#8211;\n<\/p>\n<p>\t\t&#8220;Heard<br \/>\nlearned advocates for the parties.\n<\/p>\n<p>Learned<br \/>\nadvocates for respective parties submit that the matter is amicably<br \/>\nsettled between the parties and both the husband and wife will file<br \/>\nthe divorce petition under Section 13(b) of the Hindu Marriage Act<br \/>\nbefore the Family Court and till the filing of the divorce petition<br \/>\n(for obtaining consent decree under Section 13(b)) all the<br \/>\nproceedings which are initiated by the respondent no.2-wife will be<br \/>\ncontinued. As soon as the divorce petition will be preferred by the<br \/>\nparties, the criminal proceedings initiated by the wife will be<br \/>\ndropped or prayer will be made to the Court to pass appropriate<br \/>\norder. On the date of filing of the divorce petition under Section<br \/>\n13(b) of the Hindu Marriage Act, the husband-Vanrajsinh will deposit<br \/>\nRs.14,50,000\/- by demand draft before the Family Court.\n<\/p>\n<p>On such divorce<br \/>\npetition being filed and such deposit being made, the Family Court is<br \/>\ndirected to pass order and while granting decree of divorce, it is<br \/>\ndirected to pass appropriate order to make payment of this amount<br \/>\ndeposited towards permanent alimony. Considering the submissions made<br \/>\nby the parties, it is admitted fact that marriage between husband and<br \/>\nwife is irrevocably broken and there is no possibility of reunion and<br \/>\nFamily Court will consider the same and decide the divorce petition.\n<\/p>\n<p>S.O. to<br \/>\n5.9.2011.
