PUBLIC PROSECUTOR\nfor Respondent \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.L.DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/02\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>The<br \/>\n\tappellant came to be charged for the offence of murder of his<br \/>\n\tbrother Laxmanbhai allegedly committed on 2nd July 2001<br \/>\n\taround 6:00 p.m. at Village Takhatpura by inflicting knife blows.<br \/>\n\tThe Trial Court convicted him of the same offence and sentenced to<br \/>\n\tundergo imprisonment for life and to pay a fine of Rs.5,000\/-, in<br \/>\n\tdefault, to undergo rigorous imprisonment for three months.  The<br \/>\n\tappellant was charged with an offence punishable under Section 135<br \/>\n\tof the Bombay Police Act, which the Trial Court did not believe and<br \/>\n\tacquitted the appellant.  The judgement was rendered on 17.1.2003 by<br \/>\n\tSessions Court, Modasa in Sessions Case No.125 of 2001.\n<\/p>\n<p>The<br \/>\n\tfacts of the case in brief are that the appellant and his brother<br \/>\n\tLaxmanbhai were staying near each other at Village Takhatpura.  On<br \/>\n\tthe day of incident, Laxmanbhai and his father Valabhai had some<br \/>\n\taltercation because of the cattle.  At that time, appellant was not<br \/>\n\tat home. When he came home and was about to take bath, he was<br \/>\n\tinformed about the incident.  He, therefore, got up, put on his<br \/>\n\tclothes, went inside the house and rushed towards Laxmanbhai, who<br \/>\n\twas proceeding from his home towards his field.  The appellant<br \/>\n\tattacked Laxmanbhai from behind and inflicted multiple knife blows<br \/>\n\ton various parts of the body varying from head to hand.  The injured<br \/>\n\tperson ultimately succumbed to the injuries and an FIR came to be<br \/>\n\tlodged by Gitaben, PW-2.  On basis of that FIR, offence was<br \/>\n\tregistered and investigated, and ultimately, chargesheet was filed<br \/>\n\tin the Court of Judicial Magistrate First Class, Modasa, who in turn<br \/>\n\tcommitted the case to the Court of Sessions and Sessions Case No.125<br \/>\n\tof 2001 came to be registered.  Charge was framed against the<br \/>\n\taccused at exh.3, to which he pleaded not guilty and came to be<br \/>\n\ttried and convicted as stated hereinabove.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Majmudar for the appellant submitted that the evidence<br \/>\n\tis not sufficient to record a conviction.  The Trial Court has,<br \/>\n\ttherefore, committed an error and hence, conviction be set aside.\n<\/p>\n<p>The<br \/>\n\tAppeal is opposed to by learned Additional Public Prosecutor<br \/>\n\tMr.Pandya.\n<\/p>\n<p>Our<br \/>\n\tattention is drawn by learned advocate Mr.Majmudar towards a copy of<br \/>\n\tthe letter dated 27th January 2003 addressed by the<br \/>\n\tappellant to the Hon&#8217;ble the Chief Justice, High Court of Gujarat,<br \/>\n\tcomplaining that evidences of witnesses Gitaben, Amrutbhai Patel,<br \/>\n\tUsmanbhai, Jayendrasinh Sardarsinh, Ashok Rupaji, Pannabhai,<br \/>\n\tShankerbhai and Nasibkhan were recorded in his absence and<br \/>\n\ttherefore, he suspects a foul-play.\n<\/p>\n<p>We<br \/>\n\tare presently not concerned with administrative aspect of this<br \/>\n\tcomplaint, but, we have examined the Record &amp; Proceedings in<br \/>\n\tcontext of this complaint.  We find that the evidence of witnesses<br \/>\n\tGitaben, Amrutbhai Patel, Usmanbhai and Jayendrasinh was recorded on<br \/>\n\t2nd May 2002.  We also find that, on that day, the<br \/>\n\tprisoner was not brought before the Trial Court.  However, the<br \/>\n\tadvocate for the accused tendered an application exh.7 stating that<br \/>\n\tthe accused persons are not brought from Himmatnagar and therefore,<br \/>\n\tthey may be exempted from appearing before the Court and the trial<br \/>\n\tmay be proceeded with, which came to be granted by the Sessions<br \/>\n\tCourt and as such, there is no question of any foul-play or<br \/>\n\tprejudice, particularly when the interest of the appellant was being<br \/>\n\ttaken care of by his learned advocate.\n<\/p>\n<p>(6.1)\t\tWe<br \/>\n\talso find that witnesses Ashok Rupaji, Pannabhai and Shankerbhai<br \/>\n\twere examined on 8th July 2002.  On that day also, the<br \/>\n\tappellant was not produced before the Trial Court.  We also notice<br \/>\n\tthat there is no exemption application either, but the trial has<br \/>\n\tproceeded without being objected to by the learned advocate for the<br \/>\n\tappellant   accused.  The reason seems to be that Ashok Rupaji is<br \/>\n\ta Circle Inspector of Revenue Department, who prepared the map of<br \/>\n\tthe place of incident with the help of panchnama and the witnesses<br \/>\n\tPannabhai and Shankerbhai are panch witnesses to the panchnama of<br \/>\n\trecovery of clothes of the deceased.  They have been cross-examined<br \/>\n\tby the learned advocate for the appellant.\n<\/p>\n<p>We<br \/>\n\tfind that the evidence of Nasibkhan was recorded on 27th<br \/>\n\tAugust 2002, on which day, the appellant was produced before the<br \/>\n\tCourt.\n<\/p>\n<p>It<br \/>\n\tis, thus, clear that evidence of witnesses Gitaben, Amrutbhai Patel,<br \/>\n\tUsmanbhai and Jayendrasinh is recorded in absence of the appellant<br \/>\n\tby seeking exemption from appearance and requesting the trial be<br \/>\n\tproceeded with.  The witnesses have been cross-examined by the<br \/>\n\tlearned advocate for the appellant and as such, no prejudice is<br \/>\n\tcaused to the appellant.  Similar is the situation so far as the<br \/>\n\tevidence of Ashok Rupaji, Pannabhai and Shankerbhai is concerned,<br \/>\n\twhere though there was no exemption sought, the trial has proceeded<br \/>\n\tin presence of learned advocate for the accused-appellant; the<br \/>\n\twitnesses relate to recovery of clothes of deceased and preparation<br \/>\n\tof map, which would in no way affect the evidence of eye-witnesses,<br \/>\n\tand therefore also, no prejudice is caused to the appellant.<br \/>\n\tWitness Nasibkhan is examined in presence of the appellant-accused.<br \/>\n\tThe trial, therefore, cannot be said to have been vitiated for the<br \/>\n\treason indicated in the complaint.  There is no prejudice caused to<br \/>\n\tthe interest of the appellant and therefore, it will have no bearing<br \/>\n\ton the decision of this appeal.  We, therefore, decided to proceed<br \/>\n\twith the appeal.\n<\/p>\n<p>It<br \/>\n\tis clear from the evidence that the deceased died a homicidal death.<br \/>\n\t There were multiple injuries on head, chest, neck and other parts<br \/>\n\tof the body.  The post-mortem notes exh.9 indicate the cause of<br \/>\n\tdeath to be shock due to injuries and haemorrhage.\n<\/p>\n<p>The<br \/>\n\tincident was witnessed by three witnesses, namely, (1) Gitaben<br \/>\n\tLaxmanbhai Gameti, wife of the victim, exh.12, (2) Shilpaben<br \/>\n\tLaxmanbhai, daughter of the victim, exh.26 and (3) Ursibhai Rupabhai<br \/>\n\tDodiya, exh.27. Their version is so consistent with each other that<br \/>\n\tit can be narrated commonly.\n<\/p>\n<p>(10.1)\tThe<br \/>\n\tdeceased was ahead of Ursibhai.  The appellant came from behind<br \/>\n\trushing and started inflicting knife blows indiscriminately.  The<br \/>\n\tthree witnesses speak of presence of the other two witnesses.  It is<br \/>\n\tclear from the evidence that although the incident may have roots in<br \/>\n\tthe earlier altercation between the deceased and his father, at the<br \/>\n\trelevant time, there was no altercation, no quarrel, no provocation<br \/>\n\tor fight, and the appellant straightaway inflicted the knife blows.<br \/>\n\tThe witnesses have been cross-examined at length, but they all stick<br \/>\n\tto their original version.  In fact, daughter of the deceased is a<br \/>\n\tminor.  However, she has also stood the test of cross-examination<br \/>\n\tunshakenly.\n<\/p>\n<p>The<br \/>\n\tonly argument that is advanced with little vehemence is that the<br \/>\n\toffence would not fall within the category of murder, but culpable<br \/>\n\thomicide not amounting to murder, as intention cannot be read.<br \/>\n\tHowever, it is not possible to accept this contention for the reason<br \/>\n\tthat the appellant has, on learning about the previous incident, put<br \/>\n\ton clothes, gone into the house and then has come rushing towards<br \/>\n\tthe deceased.  The deceased has not offered any provocation to him.<br \/>\n\tThere was no altercation, no quarrel, no fight.  The injuries which<br \/>\n\tare caused with the knife are on vital parts of the body.  They are<br \/>\n\tmultiple in nature and are certified to be sufficient in ordinary<br \/>\n\tcourse of nature to cause death, and in fact, the death has resulted<br \/>\n\talmost immediately after the incident.  The blows are inflicted with<br \/>\n\tforce which would also reflect intention of the appellant.  The<br \/>\n\tinjuries on neck and tenth vertebra are all vital in nature which<br \/>\n\tare inflicted with full force.  Therefore, it is difficult not to<br \/>\n\tattribute intention of causing death of the deceased to the<br \/>\n\tappellant.  The evidence is consistent and reliable.  The Trial<br \/>\n\tCourt was, therefore, justified in recording conviction.  The knife<br \/>\n\twhich was used in commission of the crime has been discovered under<br \/>\n\tpanchnama drawn under Section 27 of the Evidence Act, and that<br \/>\n\tdiscovery has been proved through panch witness Jayendrasinh<br \/>\n\tSardarsinh Sisodiya, exh.17.\n<\/p>\n<p>(11.1)\tThe<br \/>\n\tsaid knife carried bloodstains on it which is found to be of  AB<br \/>\n\tGroup in the FSL Report, exh.38.  The said blood group is that of<br \/>\n\tthe deceased.  The clothes of the appellant are also stained with<br \/>\n\tthe blood of the victim.  All these factors add corroboration to the<br \/>\n\tversion of the eye-witnesses.  We do not find any merit in the<br \/>\n\tappeal.  Therefore, the conviction is rightly recorded by the Trial<br \/>\n\tCourt.\n<\/p>\n<p>The<br \/>\n\tappeal, therefore, must fail.  Stands dismissed.
