SIRI JAGAN, J.\n                     ------------------------------\n                    W.P.(C)No.10434 OF 2007\n                   ---------------------------------\n             Dated this the 24th day of September, 2007\n\n                             JUDGMENT\n<\/pre>\n<p>      The learned counsel for the additional 3rd respondent raises<\/p>\n<p>an objection to the continuance of stay on the ground that the<\/p>\n<p>writ petition itself is not maintainable. The contention is that the<\/p>\n<p>1st respondent Company is not amenable to writjudication of this<\/p>\n<p>court in respect of such matters since there is no violation of any<\/p>\n<p>of the fundamental rights of the petitioners.       Admittedly, the<\/p>\n<p>Company is going through a severe financial crisis as a result of<\/p>\n<p>which the Company is not able to pay even the salary of the<\/p>\n<p>employees of the Company. That being so, it defies logic as to<\/p>\n<p>why the Company should take a hasty decision to give pay parity<\/p>\n<p>benefits to a set of workers that too without concurrence from<\/p>\n<p>the Government, which owns the Company. That being so, I am<\/p>\n<p>satisfied that the writ petition is maintainable. However, the<\/p>\n<p>learned counsel for the 3rd respondent submits that it is more<\/p>\n<p>appropriate that the Government decides the mater. I feel that<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.10434\/07               2<\/span><\/p>\n<p>the said submission is justified. Therefore, I dispose of this<\/p>\n<p>writ petition with a direction to the 2nd respondent to consider<\/p>\n<p>the matter in respect of which Ext.P3 is pending and pass<\/p>\n<p>appropriate orders thereon as expeditiously as possible, at any<\/p>\n<p>rate, within three months from the date of receipt of a copy of<\/p>\n<p>this judgment after affording an opportunity of being heard to<\/p>\n<p>all parties concerned, including the petitioners and the 3rd<\/p>\n<p>respondent. Till the Government takes a decision thereon the<\/p>\n<p>present position shall continue.\n<\/p>\n<\/p>\n<p>                                        S.
