Mr.Isaac Manuel                      \t\n\t\t\t    Additional Public Prosecutor\n\n:ORDER\n<\/pre>\n<p>(Order of the Court was made by P.MURGESEN, J)<\/p>\n<p>\tChallenging the order of detention, the father of the detenu has filed the<br \/>\npetition.  The detenu was detained by the second respondent Commissioner of<br \/>\nPolice by his detention order H.S.(M) Confdl. No.27\/2009, dated 03.08.2009,<br \/>\nunder the provisions of the Tamil Nadu Prevention of Dangerous Activities of<br \/>\nBoot-Leggers, Drug Offenders, Forest Offenders, Goondas, Immoral Traffic<br \/>\nOffenders, Sand Offenders, Slum-grabbers and Video Pirates Act, 1982 (Tamil Nadu<br \/>\nAct 14 of 1982) terming him as a &#8220;Goonda&#8221;.\n<\/p>\n<p>\t2. The detenu was involved in three adverse cases, which are as follows:-<br \/>\nSl\tName of the Police station \tSection of law<br \/>\nNo.\t  and Crime No.<\/p>\n<p>1\tThatchanallur P.S.\t\t147, 148, 294(b), 323, 324 and<br \/>\n\tCrime No.314\/2009\t\t506(2) IPC<\/p>\n<p>2\tOttapidaram P.S. \t\t302 and 506(2)  IPC<br \/>\n\tCrime No.124\/2009<\/p>\n<p>3\tKadambur P.S. \t\t\t387 and 506(2)  IPC<br \/>\n\tCrime No.69\/2009<\/p>\n<p>Apart from that, the detenu was involved in one ground case in Crime No.127\/2009<br \/>\nunder Sections 392 and 506(2) IPC registered in Ottapidaram Police Station for<br \/>\nthe incident that took place on 26.06.2009.\n<\/p>\n<p>\t3. Learned counsel for the petitioner has submitted that the impugned<br \/>\norder of detention passed by the second respondent is vitiated on two grounds.<br \/>\nviz., (i) The detenu has filed bail application only in the ground case in Crime<br \/>\nNo.127 of 2009 under Sections 392 and 506(2) I.P.C. on the file of the<br \/>\nOttapidaram Police Station, but no bail application was filed in the second and<br \/>\nthird adverse cases. However, the detaining authority has observed in his order<br \/>\nthat there is a real possibility of the detenue coming out of bail without any<br \/>\nmaterials and (ii) There is delay in considering the representation of the<br \/>\npetitioner.\n<\/p>\n<p>\t4.Let us decide the submissions of the learned counsel for petitioner.<br \/>\nThe detenu was arrested in Crime No.127 of 2009 for the alleged offences under<br \/>\nSections 392 and 506(2) I.P.C. on the file of the Ottapidaram Police Station and<br \/>\nhe also involved in three adverse case. The detenu has filed bail application<br \/>\nonly in respect of the ground case in Crime No.127 of 2009 on the file of the<br \/>\nOttapidaram Police Station and he has not filed any bail application for the<br \/>\nsecond and third adverse cases.  The 2nd adverse case was registered in Crime<br \/>\nNo.124 of 2009 under Sections 302 and 506(ii) on the ground that on 15.06.2009 a<br \/>\nmurder was committed.  The 3rd adverse case was registered in Crime No.69 of<br \/>\n2009 under Sections 387 and 506(2) I.P.C. on the file of the Kadambur Police<br \/>\nStation.  The detenu was arrested on 26.06.2009 in the ground case.  The<br \/>\ndetention order was clamped on 03.08.2009.  On the date of detention order the<br \/>\ndetenu has not filed any bail application in the 2nd and 3rd adverse cases.\n<\/p>\n<p>\t5.The detaining authority has observed in his order as follows:<br \/>\n\t&#8220;But he has not filed any bail applications in Ottapidaram<br \/>\nP.S.Cr.Nos.124\/09 and Kadambur P.S.Cr.No.69\/09 in the court.  It is very likely<br \/>\nthat he may come out on bail by filing bail applications for Ottapidaram<br \/>\nP.S.Cr.No.124\/09 and Kadambur P.S.Cr.No.69\/09 in the court of Judicial<br \/>\nMagistrate, Vilathikulam or higher court, and granting bail for the case of<br \/>\nOttapidaram P.S.Cr.127\/09 in the court of Judicial Magistrate, Vilathikulam.&#8221;<br \/>\nAccording to the detaining authority there is real possibility of the detenu<br \/>\ncoming out on bail. But absolutely, there is no material for the detaining<br \/>\nauthority to arrive at a conclusion that there is real possibility of detenu<br \/>\ncoming out on bail.\n<\/p>\n<p>\t6.Learned counsel for the petitioner relied on the decision of the Full<br \/>\nBench of this Court in <a href=\"\/doc\/1629814\/\">K.Thirupathi v. District Magistrate and District<br \/>\nCollector, Tiruchirapalli District &amp;<\/a> another reported  in 2005-2-L.W. 946 and<br \/>\nstressed that there is no cogent material before the Authority passing the<br \/>\ndetention order for inferring that the detenu was likely to be released on bail<br \/>\nand the inference must be drawn from material on record and must not be the ipse<br \/>\ndixit of the Authority passing the detention order.\n<\/p>\n<p>\t7.In view of the above decision, there should be some material for the<br \/>\ndetaining authority to arrive at the conclusion that there is real possibility<br \/>\nof detenu coming on bail.  On careful consideration of the materials available<br \/>\non record, we are not able to find even a single material to arrive at the<br \/>\nsatisfaction about the real possibility of the detenu coming out on bail.<br \/>\nHence, the detention order is liable to be set aside on this ground.\n<\/p>\n<p>\t8. Another ground raised by the learned counsel for the petitioner is that<br \/>\nthere is delay in considering the representation. In the proforma filed by<br \/>\nlearned Additional Public Prosecutor, it is stated as follows:\n<\/p>\n<pre>1.Category\t\t\t  : GOONDA\n2.Name of the detenu\t\t  : Thiru.Arun\n<\/pre>\n<p>3.Order of Detention Dated\t  : H.S.(M)Confdl.No.27\/<br \/>\n\t\t\t\t    2009, dated<br \/>\n\t\t\t\t    03\/08\/2009\n<\/p>\n<p>4.City\t\t \t\t  : Thoothukudi District\n<\/p>\n<p>5.Representation dated\t  : 21.08.2009\n<\/p>\n<p>6.Representation received on\t  : 15.09.2009\n<\/p>\n<p>7.Remarks called for on \t  : 16.09.2009\n<\/p>\n<p>8.Reminder dated\t\t  : 24.09.2009\n<\/p>\n<p>9.Remarks received on\t\t  : 29.09.2009\n<\/p>\n<p>10.File Submitted on\t\t  : 01.10.2009\n<\/p>\n<p>11.Under Secretary dealt with on: 01.10.2009\n<\/p>\n<p>12.Additional Secretary dealt<br \/>\n\t\t\twith on  : 01.10.2009\n<\/p>\n<p>13.Minister for (PWD&amp;LAW) dealt<br \/>\n\t\t\twith on  : 05.10.2009\n<\/p>\n<p>14.Rejection Letter prepared on: 08.10.2009\n<\/p>\n<p>15.Rejection letter sent to the<br \/>\n\t\tdetenu\t\t  : 09.10.2009\n<\/p>\n<p>18.Rejection letter served to the<br \/>\n  \t\tdetenu\ton       : Served copy awaited<br \/>\nIt is seen that the Hon&#8217;ble Minister for Public Works department and Law dealt<br \/>\nwith the representation on 05.10.2009, but the rejection letter was prepared<br \/>\nonly on 08.10.2009. Further, the remarks were called for on 16.09.2009, but the<br \/>\nsame was received only on 29.09.2009. Since, the said delay is unexplained, it<br \/>\nvitiates the order of detention.  Hence, the order of detention is liable to be<br \/>\nset aside.\n<\/p>\n<p>\t9.Accordingly, this Habeas Corpus Petition is allowed and the order of<br \/>\ndetention in H.S.(M) Confdl.No.27\/2009 dated 03.08.2009, passed by the second<br \/>\nrespondent is quashed.
