UDAYABHANU, JJ.\n\n           ==============================\n\n                          R.C.R.NO.451  OF 2006\n\n             ============================\n\n\n         DATED THIS THE 2ND DAY OF JANUARY   2007\n\n\n                                     ORDER\n<\/pre>\n<p>Udayabhanu,J.\n<\/p>\n<\/p>\n<p>      The   revision   petitioners   are   the   tenants     who   are   under<\/p>\n<p>orders of eviction   as per the   concurrent findings of the courts<\/p>\n<p>below on the application filed by the landlord under Section 11(4)<\/p>\n<p>(i)of  the Kerala Buildings Lease &amp; Rent Control Act. It is the case<\/p>\n<p>of   the   petitioners   that   the   first   petitioner,   who   is   the   original<\/p>\n<p>lessee,   is   in   legal   possession   of   the   premises   and   that     the<\/p>\n<p>alleged sub-letting  stands not proved.\n<\/p>\n<\/p>\n<p>      2. On a perusal of the orders of the courts below, we find<\/p>\n<p>that   the   respondent\/landlord   has   completely   succeeded   in<\/p>\n<p>piercing   the   veil   of   the   alleged   partnership,   although   the<\/p>\n<p>partnership deed is a registered one.   It was found   on evidence<\/p>\n<p>in  the   cross   examination   of     respondents   1   and  2,   i.e.  the  first<\/p>\n<p>respondent,   the   original   lessee,   and   the   third   respondent,   who<\/p>\n<p><span class=\"hidden_text\">RCR.451\/2006                             -2-<\/span><\/p>\n<p>was made a partner as per the partnership deed                      subsequently<\/p>\n<p>executed,   that virtually the first respondent has no role at all in<\/p>\n<p>the business conducted in the premises.  Moreover he is not even<\/p>\n<p>aware of any of the details of the business activities conducted in<\/p>\n<p>the premises; he is not aware   of the only staff employee in the<\/p>\n<p>business; he is not aware of   whether   the firm is   assessed to<\/p>\n<p>income-tax  and he has not seen  the accounts maintained.  The<\/p>\n<p>third respondent who was examined as RW2, who is a relative of<\/p>\n<p>the 2nd  respondent, is not aware of the investment made in the<\/p>\n<p>business.   It was found that  almost the entire profits as per the<\/p>\n<p>terms of the partnership deed will go to the 2nd  respondent.   No<\/p>\n<p>account books to prove the investment or disbursement of profits<\/p>\n<p>were   produced.   The   courts   below   concurrently   found   that   the<\/p>\n<p>partnership deed registered is only  to camouflage the sub-lease.<\/p>\n<p>On   facts,   we   find   that     the   findings   of   the   courts   below   are<\/p>\n<p>impenetrable. There is no reason to interfere   in the findings of<\/p>\n<p>the   courts   below.         The   rent   control   revision   is   liable   to   be<\/p>\n<p>dismissed at the threshold and we do so.\n<\/p>\n<\/p>\n<p>      Considering   the   plea   of   the   counsel   for   the   revision<\/p>\n<p>petitioners,   the   petitioners   are   granted   four   months   time   from<\/p>\n<p><span class=\"hidden_text\">RCR.451\/2006                              -3-<\/span><\/p>\n<p>today   onwards   to   vacate   the   premises     on   condition   that   they<\/p>\n<p>shall   remit   the   entire   arrears   of   rent,   if   any,     and   continue   to<\/p>\n<p>remit   the     rent   due   and   file   an   affidavit     before  the     execution<\/p>\n<p>court     within   15   days   from   today   that   the   premises   shall   be<\/p>\n<p>vacated on or before 2-5-2007.\n<\/p>\n<\/p>\n<p>                                                         Sd\/-\n<\/p>\n<p>                                                  K.A.ABDUL GAFOOR<\/p>\n<p>                                                         JUDGE<\/p>\n<p>                                                         Sd\/-\n<\/p>\n<pre>ks.
