NO. 21879 OF 2006\n                        --------------------------------------------------------\n                          Dated this the 16th day of August 2006\n\n\n                                           JUDGMENT\n<\/pre>\n<p>        Petitioner who was initially appointed as staff nurse in the Health Services<\/p>\n<p>Department through Public Service Commission was subsequently appointed as<\/p>\n<p>Tutor on a regular basis in the College of Nursing under the Medical Education<\/p>\n<p>Department  in November,  1989.     Apart  from Graduation  in Nursing,  petitioner<\/p>\n<p>had also obtained masters degree in the same subject in the year 1999.   After<\/p>\n<p>acquisition   of   her   post   graduation,   petitioner   was   redesignated   as   Senior<\/p>\n<p>Lecturer.    Other lecturers who did not  acquire P.G    qualification  continued as<\/p>\n<p>lecturers.     Later   they   were   given   the   scale   of   pay   of   Assistant   Professor   on<\/p>\n<p>completion     of 10 years physical teaching experience.   Petitioner is still being<\/p>\n<p>paid the salary of Senior Lecturer, though she has also completed 10 years of<\/p>\n<p>physical   teaching   experience.     I     do   not   propose     to   deal   with   the   various<\/p>\n<p>contentions  raised by the  petitioner at  this stage in view of the  limited prayer<\/p>\n<p>made by the learned counsel at the Bar.   It is submitted that petitioner will be<\/p>\n<p>satisfied if an appropriate direction is issued to Respondent No.1 to consider and<\/p>\n<p>pass   orders   on   Ext.P5   in   which   petitioner   is   stated   to   have   highlighted   her<\/p>\n<p>grievances and pointed out the anomalies.\n<\/p>\n<\/p>\n<p>        2.The   learned   Government   Pleader   submits   that   if   Ext.P5   has   been<\/p>\n<p>preferred as contended by the petitioner an  appropriate decision thereon will be<\/p>\n<p>taken without  any delay.\n<\/p>\n<\/p>\n<p>        In the above facts and circumstances the writ petition is disposed of with a<\/p>\n<p>direction to Respondent No.1 to consider and pass orders on Ext.P5 strictly on<\/p>\n<p>its merit and in accordance with law as expeditiously as possible , at any rate<\/p>\n<p>within 3 months from the date of receipt of copy of this judgment.  Petitioner and<\/p>\n<p>all   others   who   are   likely   to   be   affected   by   the   order   that   may   be   passed   by<\/p>\n<p>Respondent   No.1   shall   be   afforded   sufficient   opportunity   to   be   heard   while<\/p>\n<p>considering Ext.P5. The petitioner shall produce certified copy of this judgment<\/p>\n<p>along  with a copy of the writ petition before respondent  No.1 for compliance.<\/p>\n<p>                                                            A.K.
