    Petitioner is the accused in S.T.113\/2010<\/p>\n
on the file of Judicial First Class Magistrate-<\/p>\n
II  taken  cognizance  for  the  offence  under<\/p>\n
section 138 of Negotiable Instruments Act on a<\/p>\n
complaint  filed  by   the  first   respondent.<\/p>\n
According  to  petitioner,  after  closing  the<\/p>\n
evidence  of  the  first   respondent,  learned<\/p>\n
Magistrate  directed  the   petitioner  to   be<\/p>\n
present in person and as the    offence alleged<\/p>\n
is  only  under   section  138  of   Negotiable<\/p>\n
Instruments Act, learned Magistrate should not<\/p>\n
have  insisted   for   the  presence   of   the<\/p>\n
petitioner.  As petitioner did not appear as<\/p>\n
directed, learned Magistrate has already issued<\/p>\n
a non bailable warrant.  This petition is filed<\/p>\n
under Article 227 of the Constitution of India<\/p>\n
O.P.(Crl.) 203\/2010             2<\/span><\/p>\n
for a direction to the Magistrate not to insist for<\/p>\n
the     personal      appearance of  the  petitioner  for<\/p>\n
questioning         under section 313 of Code of Criminal<\/p>\n
Procedure.\n<\/p>\n
      2.           Learned  counsel  appearing  for   the<\/p>\n
petitioner was heard.\n<\/p>\n
      3.       Learned counsel submitted that petitioner<\/p>\n
had filed an application under section 205 of Code<\/p>\n
of     Criminal       Procedure  and  his  presence   was<\/p>\n
dispensed          and  in  such  circumstances,  learned<\/p>\n
Magistrate is not justified in insisting for the<\/p>\n
presence of the petitioner.\n<\/p>\n
      4.      Normally in a case taken cognizance for the<\/p>\n
offence under section 138, if an application is<\/p>\n
filed, learned Magistrate not to insist for the<\/p>\n
personal presence of the accused for questioning<\/p>\n
under section 313 of Code of Criminal Procedure, if<\/p>\n
his presence was dispensed with earlier on an<\/p>\n
application filed under section 205 of Code of<\/p>\n
Criminal         Procedure.    If  after     allowing  an<\/p>\n
application under section 205 Cr.P.C.,        the counsel<\/p>\n
O.P.(Crl.) 203\/2010            3<\/span><\/p>\n
for the petitioner as promised did not appear<\/p>\n
before the learned Magistrate, it is possible that<\/p>\n
learned Magistrate         insisted for the presence of<\/p>\n
the accused.         From the material it is not possible<\/p>\n
to hold that learned Magistrate directed         personal<\/p>\n
presence of the accused illegally.<\/p>\n
      Petition       is disposed  making  it  clear  that<\/p>\n
learned Magistrate not to insist for the presence<\/p>\n
of the petitioner for questioning under section 313<\/p>\n
of Code of Criminal Procedure, if his presence was<\/p>\n
dispensed         under  section 205   Code  of  Criminal<\/p>\n
Procedure earlier.         Even if it was not permitted<\/p>\n
earlier,         if a petition is filed under section 205<\/p>\n
Code of Criminal Procedure         learned Magistrate to<\/p>\n
consider the same in accordance with law and pass<\/p>\n
appropriate         orders.    If  petitioner  files   an<\/p>\n
application           for  recalling  the  non   bailable<\/p>\n
warrant, learned Magistrate to pass appropriate<\/p>\n
order in accordance with law.\n<\/p>\n<\/p>\n
