He is aggrieved by the grant of bail to Respondents<\/p>\n<p>2   to   9   by   the   Special   Judge-II,   CBI,   Ernakulam   in   Crime   RC<\/p>\n<p>No.13(A)\/2004.\n<\/p>\n<p>      2.     In respect of a contract, which was entered into by the<\/p>\n<p>FACT in 1997, very serious allegations of corruption were raised.\n<\/p>\n<p>According to the petitioner, the trade unions of employees had,<\/p>\n<p>even at the time when the contract was entered into, entertained<\/p>\n<p>reservations   and   raised   objections   against   such   contract   being<\/p>\n<p>entered   into   to   the   detriment   of   the   interests   of   the<\/p>\n<p>establishment.     Long   later,   on   27\/05\/2004,   the   CBI   had<\/p>\n<p>registered a crime suo moto.   Investigation  continued and later<\/p>\n<p>in   September   2006,   respondents   2   to   9   were   arrested.     They<\/p>\n<p>were   produced   before   the   learned   Special   Judge.     They   were<\/p>\n<p>enlarged on bail.\n<\/p>\n<p>      3.     The   petitioner   complaints   that   the   release   on   bail   is<\/p>\n<p>unjustified.     The   allegations   are   serious.     At   least   till   the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3374\/06                      2<\/span><\/p>\n<p>investigation is completed, bail should not have been granted to<\/p>\n<p>the accused\/respondents, it is contended.\n<\/p>\n<p>      4.     That application is opposed by the learned counsel for<\/p>\n<p>the accused that is respondents   2 to 9.   There is absolutely no<\/p>\n<p>justification in the prayer made by the petitioner, a stranger for<\/p>\n<p>cancellation   of   bail.     By   no   stretch   of   imagination,   can   it   be<\/p>\n<p>contended   that   continued   detention   of   the   respondents   is<\/p>\n<p>necessary   for   any   proper   or   effective   investigation.     They   pray<\/p>\n<p>that this petition may be dismissed.\n<\/p>\n<p>      5.     The   learned   Standing   Counsel   for   the   CBI   also<\/p>\n<p>submits   that   the   CBI   does   not   want   to   raise   any   objections<\/p>\n<p>against the grant of bail.   The CBI does not endorse the request<\/p>\n<p>for   cancellation   of   bail.     The   alleged   incident   had   taken   place<\/p>\n<p>long back in 1997 and it is after detailed enquiry that the crime<\/p>\n<p>was   registered   on   27\/5\/2004.                  Thereafter,   necessary<\/p>\n<p>investigation was conducted and the CBI came to the conclusion<\/p>\n<p>about   the   complicity   of   the   respondents   and   effected   arrest   in<\/p>\n<p>September   2006.     For   the   purpose   of   investigation,   their<\/p>\n<p>continued detention is not necessary.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3374\/06                        3<\/span><\/p>\n<p>       6.     The  CBI  has already completed  the investigation and<\/p>\n<p>has   filed   charge   sheet   also.       In   these   circumstances,   the   CBI<\/p>\n<p>does   not   agree   with   the   request   of   the   petitioner   that   bail<\/p>\n<p>granted must be cancelled.\n<\/p>\n<p>       7.     Having heard both the counsel and having considered<\/p>\n<p>all   the   relevant   inputs,   I   find   absolutely   no   merit   to   invoke   the<\/p>\n<p>powers of this court for cancellation of bail.  Investigation having<\/p>\n<p>already   been   completed   and   the   alleged   incident   having   taken<\/p>\n<p>place   long   earlier   in   1997,     I   find   no   reasonableness   in   the<\/p>\n<p>apprehension that a proper trial\/adjudication  will  be impossible<\/p>\n<p>if the respondents are allowed to remain in bail.\n<\/p>\n<p>       8.
