   Before the Trial Court. on bchaif of the p1a:i;ati\ufb02’ one<\/p>\n
 Nair was mcamined as PW1. Defendant himscif got<\/p>\n
 as DWI. Exs.F’1 to 7 were marked in the evidence of<\/p>\n
PW}. No documents were produced bv the defendant.<\/p>\n
5. Trial Court dismissed the suit by observing that, there
\nis over  at Ex.P’4 by striking some name and vzri\ufb01ng the<\/p>\n
name of defendant over the same and disbelieving Ex.P5~ ledger<\/p>\n
book observed that, no documents are produced by the <\/p>\n
to prove the transaction.\n<\/p>\n
6. Sri S.V.Prakash, learned counsel  the”  t <\/p>\n

\nShimoga, in respect of the very satee   <\/p>\n
7. The  the defendant had
\nissued cheqtie   h the transaction and the
\ndefexidanffs’  is total denial of transaction,
\n isV_’:L’jt1eE :e:i.’p1a1t2tfie11…..by the defendant as to in what<\/p>\n
 the was issued. No doubt the original cheque<\/p>\n
  the Trial Court, Ex.P4 credit bili,
\n  and Form ‘C: and Form ‘A’ are produced<\/p>\n
  \u00e9  the Court, the Trial Court without looking into these
\n also without cons\ufb02ering the criminal proceedm gs<\/p>\n

 has dismissed the suit, in my opinion, the matter<\/p>\n
