He has<br \/>\nalso referred to the map and submitted that the way which has been<br \/>\nclaimed is not reflected in the government record and therefore both<br \/>\nthe courts below have committed an error. Learned advocate Mr. Mehta<br \/>\nhas also submitted that the map of the DILR does not reflect the<br \/>\npresent right of way. He has therefore submitted that the present<br \/>\nrevision application may be allowed.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. NV Gandhi has submitted that the scope of exercise of<br \/>\ndiscretion under sec. 115 of CPC is very limited. In support of this<br \/>\nsubmission, he has referred to and relied upon the judgment of this<br \/>\nCourt reported in 2006(3) GLR 2031. He has also referred to and<br \/>\nrelied upon the judgment of this court reported in 2007 JX(Guj) 205<br \/>\nand submitted that the Court of Mamlatdar has jurisdiction to issue<br \/>\ninjunction granting prohibitory order.\n<\/p>\n<p>4.\tHe<br \/>\nhas therefore submitted that after hearing the parties and after<br \/>\nmaking the panchnama with regard to the exact right of way the map is<br \/>\nprepared and it has been confirmed by both the courts below that<br \/>\nthere is a right of way existing and therefore the present revision<br \/>\napplication may not be entertained.\n<\/p>\n<p>5.\tIn<br \/>\nview of rival submissions, it is required to be considered whether<br \/>\nthe present application can be entertained or not.\n<\/p>\n<p>6.\tThough<br \/>\nthe submissions have been made by learned advocate Mr. Mehta at<br \/>\nlength referring to the papers and also the list of documents, as it<br \/>\ntranspires from the record, the inspection was made on the spot and<br \/>\nthe way has been found to be existing.  It has been discussed in<br \/>\ndetail in the panchnama made including even the width of the road<br \/>\npassing through different fields including of the present applicant.<br \/>\nIn the circumstances, as there are two concurrent finding of fact<br \/>\ngiven by the courts below, the present revision application cannot be<br \/>\nentertained, particularly having regard to the limited scope of<br \/>\nexercise of discretion under sec.115 of CPC and the revisional<br \/>\njurisdiction.\n<\/p>\n<p>7.\tThe<br \/>\nHon&#8217;ble Apex Court in a judgment in the case of <a href=\"\/doc\/302403\/\">Yunis Ali (Dead) Thru<br \/>\nL.Rs. v. Khursheed Akram,<\/a> reported in AIR 2008 SC 2607 has clearly<br \/>\nobserved that interference with well merited concurrent findings by<br \/>\nHigh Court in revision simply because another view of evidence is<br \/>\npossible is not proper.\n<\/p>\n<p>8.\tTherefore,<br \/>\nthe present revision application deserves to be rejected and<br \/>\naccordingly stands rejected.\n<\/p>\n<p>9.\tLearned<br \/>\nadvocate Mr. Mehta has submitted that it may be clarified that this<br \/>\nmay not be treated as giving any findings and the observations  may<br \/>\nnot be treated as final in any other proceedings. Therefore, it is<br \/>\nclarified that if and when any such proceeding is initiated, the same<br \/>\nmay be considered in accordance with law and evidence.\n<\/p>\n<p>(Rajesh<br \/>\nH.
