Justice V.RAMKUMAR\n\n Dated :13\/09\/2010\n\n O R D E R\n                        V.RAMKUMAR, J.\n             ----------------------------------------------\n             Bail Application No.5142 of 2010\n            ------------------------------------------------\n        Dated this the 13th day of September, 2010\n\n                               ORDER\n<\/pre>\n<p>      The petitioners, who are accused Nos.1 &amp; 2 in Crime<\/p>\n<p>No.433\/2010 of Kasaragod Police Station for offences<\/p>\n<p>punishable under Sections 341, 323, 324, 365, 308 &amp; 427 read<\/p>\n<p>with Section 34 I.P.C., seek anticipatory bail.<\/p>\n<p>      2.   The    learned     Public     Prosecutor      opposed the<\/p>\n<p>application.\n<\/p>\n<p>      3.    Anticipatory bail cannot be granted in a case of<\/p>\n<p>this nature. But at the same time, I am inclined to permit the<\/p>\n<p>petitioners to surrender before the Investigating Officer for<\/p>\n<p>the purpose of interrogation and then to have their application<\/p>\n<p>for bail considered by the Magistrate having jurisdiction.<\/p>\n<p>Accordingly, the petitioners shall surrender before the<\/p>\n<p>investigating officer on 23\/9\/2010 or on 24\/9\/2010 for the<\/p>\n<p>purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any.
