SAHAI &amp; B.L HANSARIA, JJ.)\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>HANSARIA, J.:\n<\/p>\n<p>1.The  appellant has a grievance that is  fundamental  right<br \/>\nunder Article 16 has been infringed by not promoting him  in<br \/>\nthe Indian Administrative Service in time as required by the<br \/>\nconcerned   provisions\tgoverning  the\tpromotion  to\tthat<br \/>\nService.   This\t grievance  has\t taken\tan  aggravated\tform<br \/>\nbecause of promotion of his juniors.\n<\/p>\n<p>2.   The  appellant approached Gauhati High Court  with\t the<br \/>\naforesaid grievance which gave rise to Civil Rule No.256  of<br \/>\n1978.  the  writ petition stood transferred to\tthe  Central<br \/>\nAdministrative\tTribunal,  Gauhati  Bench  by  operation  of<br \/>\nsection\t 29 of the Administrative Tribunals Act, 1985.\t The<br \/>\nTribunal,  instead  of\tgoing  through\tthe  merits  of\t the<br \/>\ngrievance, accepted the preliminary objection raised by\t the<br \/>\nState  Government about the delay in filing the\t application<br \/>\nand  dismissed the same on that ground.\t  Feeling  aggrieved<br \/>\nthis appeal has been preferred.\n<\/p>\n<p>3.   To do complete justice between the parties, we  thought<br \/>\nit  would be appropriate to examine the merits of  the\tcase<br \/>\ninstead of non-suiting the appellant on the ground of delay.<br \/>\nWith  this  point  in view, the appeal\twas  once  heard  on<br \/>\n20.10.94, when need for perusal of the service record of the<br \/>\nappellant  from\t 1970  till  1982  and\tproceedings  of\t the<br \/>\nSelection  Committee  from 1974 till 1980 was  felt.   These<br \/>\nrecords\t were  produced before us on 8th December,  1994  on<br \/>\nwhich date hearing was closed.\n<\/p>\n<p>4.   The  need\tfor perusal of the aforesaid  documents\t was<br \/>\nfelt  because the case of the respondent-State (Manipur)  is<br \/>\nthat  name of the appellant had been duly forwarded  to\t the<br \/>\nSelection  Committee which had considered his case  also  in<br \/>\nits meetings which held in 1974, 1976, 1977 and 19801;\n<\/p>\n<p><span class=\"hidden_text\">165<\/span><\/p>\n<p>but  the  appellant  was not found  fit\t and  the  Selection<br \/>\nCommittee   did\t not  recommend\t his  name  for\t  promotion.<br \/>\nUltimately, the name of the appellant came to be recommended<br \/>\nin 1981 and he was subsequently promoted.\n<\/p>\n<p>5.   A\tperusal of the aforesaid records does show that\t the<br \/>\nappellant&#8217;s  name had been considered in 1974,\t1976,  1977,<br \/>\n1980 by the Selection Committee.  It is to be further  found<br \/>\nthat in 1974 the non-recommendation was not only due to non-<br \/>\nissuance  of integrity certificate by the concerned  officer<br \/>\nof  the State which, it may be stated, was because  of\tsome<br \/>\ndisciplinary.  proceeding  pending  against  the   appellant<br \/>\nrelating  to  his  integrity which  proceeding\tcame  to  be<br \/>\ndropped afterwards, but also because the Selection Committee<br \/>\ntook note of adverse remarks in the ACRs o the appellant and<br \/>\nobserved  that his speed in working output was slow  and  be<br \/>\nwas censured in 1969-70.\n<\/p>\n<p>6.   These  factors which were taken note by  the  Selection<br \/>\nCommittee arc undoubtedly relevant.  We would, however,\t ob-<br \/>\nserve that the adverse remarks related to the allegation  of<br \/>\nembezzlement,  which  must be taken to have been  wiped\t out<br \/>\nbecause\t of  the  dropping of  the  disciplinary  proceeding<br \/>\nsubsequently.\t Other\tfactors\t noted\tby   the   Selection<br \/>\nCommittee receive support from what finds place in the\tACRs<br \/>\nof the appellant.  Insofar as censure is concerned, we\thave<br \/>\nseen the order of the Chief Secretary, Government of Manipur<br \/>\ndated  30th  July, 1969, which the appellant  was  censured.<br \/>\nThis  had  come\t to happen because of-\tthe  issuance  of  a<br \/>\ncertificate  by\t the appellant in favour of one\t Ibo  Pishak<br \/>\nSingh stating that his total income was Rs.600\/- per  annum.<br \/>\nOn  the basis of this certificate,  Post-Matric\t Scholarship<br \/>\nmeant  for low income group students came to be, awarded  to<br \/>\nIbo  Pishak Singh.  It, however, appears from what has\tbeen<br \/>\nin the Chief Secretary&#8217;s order that the certificate had been<br \/>\nissued\tcarelessly  without proper verification; and  so,  a<br \/>\nlenient\t view was taken as there was no mala fide  intention<br \/>\nand   the   appellant  came  to\t be  censured.\t  The\tnon-<br \/>\nrecommendation\tof the appellant in 1974 was thus  for\tgood<br \/>\nand cogent reasons.\n<\/p>\n<p>7.   Insofar as 1976 consideration is concerned, the  reason<br \/>\nfor  supersession have been recorded thus: &#8220;His\t performance<br \/>\nhas been found to be only fair, was censured a few year ago.<br \/>\nneeds  to  acquire more experience and show  better  results<br \/>\nbefore he can be promoted.&#8221; These are cogent masons for\t not<br \/>\nrecommending the appellant in that year.\n<\/p>\n<p>8.   The  minutes  of the meeting concerning the  year\t1977<br \/>\nshows  that the Selection Committee recommended\t two  names,<br \/>\none of which was of Shri RK Modhusana Singh who belonged  to<br \/>\ngeneral\t category  and another Shri LS Thangjon\t who  was  a<br \/>\nScheduled  Tribe.   RK Modhusana Singh was  the\t junior-most<br \/>\nincumbent   in\tthe  list  of  eligible\t  candidates.\t His<br \/>\nassessment was, however, recorded as &#8220;very good&#8221; whereas qua<br \/>\nthe appellant it had been stated &#8220;unfit&#8221;.  As the  appellant<br \/>\nwas being superseeded by one of his juniors, we do not think<br \/>\nif  it was enough on the part of the Selection Committee  to<br \/>\nhave merely stated &#8220;&#8216;unfit&#8221;&#8216;, and then to recommend the name<br \/>\nof one of his juniors.\tNo for unfitness is reflected in the<br \/>\nproceedings,  as against what earlier  Selection  Committees<br \/>\nhad done to which reference has already been made.\n<\/p>\n<p><span class=\"hidden_text\">166<\/span><\/p>\n<p>9.   Despite the above, we do not propose to interfere\twith<br \/>\nthis  supersession  of the appellant because we\t have  found<br \/>\nthat  Madhosana\t Singh\twas rated  &#8216;very  good&#8221;,  whereas  a<br \/>\nperusal of the ACRs of the appellant shows that he cannot be<br \/>\nrated  as  &#8220;very  good&#8221;, indeed, it would  be  difficult  to<br \/>\nregard him even as &#8220;good&#8221;.  So, no injustice has really been<br \/>\ncaused to the appellant in the recommendation of one of\t his<br \/>\njuniors\t for  promotion.  As to Thangjon, it may  be  stated<br \/>\nthat  he  was  the only Scheduled  Tribe  candidate  amongst<br \/>\neligible  persons.   This  apart, his  assessment  has\tbeen<br \/>\nrecorded as &#8220;good&#8221;.  This shows that there was no unfairness<br \/>\nor arbitrariness in the proceeding of the Selection  Commit-<br \/>\ntee of that year.\n<\/p>\n<p>10.The last year with which we are concerned is 1980,and  in<br \/>\nthat  year  what happened was the  Selection  Committee\t had<br \/>\nrecommended four names of State Civil Services Officers\t and<br \/>\nthese  were  of; (1) Sh. S. Sarat Singh; (2)  Shri  A  Sarat<br \/>\nChander\t Singh; (3) RK Modhusana; and (4) Shri\tRK  Birendra<br \/>\nSingh.\t The assessment of the first three  recommendees  as<br \/>\nnoted in the proceedings of the Selection Committee, is that<br \/>\nall were &#8220;very good&#8221;, and it is because of this that  though<br \/>\nthey were last three in the list of eligible candidates they<br \/>\nwere  preferred over their seniors.  The fourth,  namely  RK<br \/>\nSingh  is the senior most among the eligible candidates\t and<br \/>\nit  is because of this that of the remaining five  his\tname<br \/>\nwas  recommended.   The appellant was immediately  below  RK<br \/>\nBirendra  Singh\t in the list o eligible candidates  and\t had<br \/>\nbeen  rated as &#8220;good&#8221;, as was RK Birendra Singh; but as\t the<br \/>\nSelection Committee could have recommended only four  names,<br \/>\nhis name could not be recommended.\n<\/p>\n<p>11.The aforesaid shows that no illegality had been committed<br \/>\nby  the Selection Committee or injustice had been caused  in<br \/>\nnot  recommending the name of the petitioner prior  to\t1981<br \/>\nfor  his  promotion to Indian Administrative  Service.\t We,<br \/>\ntherefore,do  not read any infraction of Article 16  in\t the<br \/>\nappellant    having   been   promoted\tpursuant   to\t the<br \/>\nrecommendation made in 1981 only.
