It<br \/>\nappears that thereafter the services of the petitioners were<br \/>\nterminated. However, in Special Civil Application No.42 of 2001 as<br \/>\nwell as in Special Civil Application No.44 of 2001, the concerned<br \/>\npetitioners preferred a writ petition before this Court challenging<br \/>\nthe said decision whereas, the petitioners of  Special Civil<br \/>\nApplication No.43 of 2001 raised dispute under the Industrial Dispute<br \/>\nAct which ultimately came to be referred to the labour court. In the<br \/>\npetitions preferred by the aforesaid two petitioners, being Special<br \/>\nCivil Application No.7109 of 1992 and 360 of 1993, when it came for<br \/>\nhearing before this Court on 09.02.2001, a statement was made by the<br \/>\nlearned counsel for the petitioners that the services of the<br \/>\npetitioners have been made permanent with effect from 01.05.1999 and<br \/>\ntherefore, the petitions came to be disposed of as having become<br \/>\ninfructuous. However, in respect of the petitioner<br \/>\nof Special Civil Application No.43 of 2001, it appears that the<br \/>\nlabour court passed the award in the Reference Case No.1450 of 1990<br \/>\nwhereby, he was ordered to be reinstated with 30% back wages to his<br \/>\noriginal post. It appears that thereafter, once again the Market<br \/>\nCommittee directed to place the concerned petitioners to their<br \/>\noriginal position of fixed pay-scale without giving any opportunity<br \/>\nof hearing to the petitioners. The petitioners, under these<br \/>\ncircumstances, have preferred the present petitions.\n<\/p>\n<p>2.\tThe<br \/>\npertinent aspect is that the Market Committee has not filed any reply<br \/>\nwhatsoever. However, Mr.Desai, learned counsel appearing for the<br \/>\nMarked Committee, contended that as the District Registrar had so<br \/>\ndirected, the Market Committee has passed the impugned order which is<br \/>\nchallenged in the present petition but the directions of the District<br \/>\nRegistrar are not placed on record.\n<\/p>\n<p>3.\tIt<br \/>\nis undisputed position that the opportunity of hearing has not been<br \/>\ngiven to any of the petitioners by the Market Committee before<br \/>\npassing the impugned order. The another relevant aspect is that the<br \/>\npetitioners have been working as daily wagers and thereafter their<br \/>\nservices were made permanent since 1999 and therefore, even if any<br \/>\nadverse action is to be taken, it would be required for the Market<br \/>\nCommittee to give the opportunity of hearing to the petitioners then<br \/>\nto pass the order. In order to see that the Market Committee does not<br \/>\nshirk its responsibility as assigned under the law, it would be just<br \/>\nand proper if such action of the Market Committee is also supervised<br \/>\nby the District Registrar.\n<\/p>\n<p>4.\tIn<br \/>\nview of the aforesaid, the impugned order passed by the Market<br \/>\nCommittee is quashed and set aside with further direction that the<br \/>\nMarket Committee shall give the opportunity of hearing and shall pass<br \/>\na fresh order after getting the approval of the District Registrar<br \/>\nfor such purpose. It is observed that in the event the approval is<br \/>\nnot granted or the order is against the petitioners, the petitioners<br \/>\nshall be at liberty to challenge the same in accordance with law and<br \/>\nat that stage, the rights and contentions of both sides shall remain<br \/>\nopen.\n<\/p>\n<p>5.\tThe<br \/>\npetitions are partly allowed to the aforesaid extent. Rule is made<br \/>\nabsolute.
