DAVE\n\t\t\n\t\n\n \n\nDate\n: 02\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Learned APP, waives service of rule on behalf of respondent-State.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant submits that the applicant has inflicted<br \/>\nthe injuries with &#8216;axe&#8217; on the head of the complainant and further<br \/>\ncaused injuries on two other witnesses but at the same time nature of<br \/>\ninjuries were such, for which, injured came to be discharged from the<br \/>\nhospital and other aspects is in realm of evidence to be appreciated<br \/>\nby the trial Court and with regard to antecedents referred by the<br \/>\ntrial Court, the applicant was acquitted in two out of four criminal<br \/>\ncases.  Now charge-sheet is filed and by imposing suitable conditions<br \/>\nthe applicant may be enlarged on bail.\n<\/p>\n<p>\tConsidering<br \/>\nthe above prima facie aspects of the matter, I find this is a fit<br \/>\ncase for granting bail since charge-sheet is also filed. Under the<br \/>\ncircumstances, the applicant is ordered to be released on bail in<br \/>\nconnection with C.R. No.I-4 of 2011 with Narayansarover Police<br \/>\nStation, on his furnishing bond of Rs. 5000\/-(Rupees Five Thousand)<br \/>\nwith one surety of like amount to the satisfaction of the lower Court<br \/>\nand subject to following conditions :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
